If you have a contract with them to give you a certain amount of paid vacation time each year, then they are violating that contract by not compensating you for the 8 hours they take.

Companies can legally do pretty much anything they want.

Especially regarding vacations.

They can even require you to use all your vacation time during a specific month or season.

EDIT: unless you have a signed contract with them stating otherwise.

But the big question is whether vacation time is paid or unpaid normally. If unpaid, fine, but if paid, then this is not acceptible.

we are getting the 24-26th off as paid company holidays. 🙂

Same here. 😀

I'm non-union salary...but our perks are equal to the unionized hourly workforce.....regarding holidays.

Do you normally get paid for vacation time? If so, why are they not paying you if they're docking you a vacation day? Does your company have an employee handbook?

Unless you have a signed contract....the company can do whatever they want regarding vacations....time or money. They can even knock your salary down 10% tomorrow if they wish.

They are docking 8 hours from my vacation time. But its running low, and wanted to save as much as I can for the birth of my son in 4 weeks. Thats one less day i get to spend with him...
Read up on FMLA. I was able to take 5 weeks off when my daughter was born and charge it to my sick leave (I have hundreds of hours racked up) instead of vacation leave.

Most of us don't work for the government, so we can't roll over sick time.

No sir, you are wrong. If the company has an employee handbook, that's as good as a signed contract.

True, but FMLA still applies to everyone in some respect so it's good to read up if you have a kidlet on the way.

You'll have to check the emploment laws in your state. It may, or may not, be illegal. Your state may have an office that deals with fair employment practices.

If you press the issue, you may also have to dance a fine line to keep from getting hosed, later, if your employer gets pissed. You'll probably have better luck with that if you can get a lot of your fellow employees to join you in your objections.

No matter what happens, it's a sh8ty thing for your employer to do. Good luck. 🙂

Don't you get your vacation replenished on January 1, 2004?
In four weeks, you should be in good shape because you should be using '04 vacation time and not '03.
Unless your not being entirely accurate about how your vacation time is distributed.

Anyway, I agree. Quit your whining.
I work for a company that's laid off 11,000 people.
I'm not bitching about anything these days.
Not as long as those checks keep rolling in every two weeks.

If your REALLY pissed, I suggest going into work armed with multiple automatic weapons.
That should turn things around for you.

Merry Christmas and congratulations on the impending birth of your son.
You two can have a whine-off in a couple more weeks.
See who cries the loudest.

O I will be whining louder
good point about the whole happy to be employed. I understand that, and believe me I am, especially when i have a fam to support. But when i feel im done wrong, should I just sit around and let an emplorer fnck me no vaseline?

Am I blind, or have you not told us whether you normally get paid for vacation hours?

Sorry dude,
Yes, i get paid for vaca hours

Then I can see them making you take an unpaid vacation, but I don't see how they could take 8 hours without compensation. Do you have any written proof that you normally get paid for vacation hours?

It might be time to point out to coworkers that they are violating their policy of paying for time docked from "vacation time". I'm not saying that the employer doesn't have the right to make everyone take the day off unpaid, but your vacation time should not change because of it unless they pay you back.

OK, My employer is a privately owned computer disty. I just got out of a meeting, and my boss told us that they will be closed on Dec, 24th. The thing is, she is docking 8 hours from our vacation time. Thats pretty sh!tty. Now Dec 31st is our floating holiday, so we will get paid for that day, but not for the 24th.

Welcome to the real world

Tell me about it. My wife took the full 12 weeks (which is nice) but isn't getting paid (which sucks).

The irony: she works for a health benefits management company and their own benefits freaking suck. Non-paid maternity leave is crap IMHO. What is a woman supposed to do if she has a kid and is the primary breadwinner for the household?
