Apparently this case will be much different that others because the music was not yet released and money was exchanged which makes the whole thing far worse.

Did they give back the extra?

The amount doesn't so much matter, the point is that some quantity of money was donated, which doesn't look good to the majority of people outside this scene. And some of it will have left a trail leading back to some unlucky folks.

My question is how useful will the logs from the tracker be in going after users. Is that level of "evidence" good enough for civil suits?

no they did not
all donating did was give you access the more advanced search function, which you got anyway once you got a certian ratio

it was straigt up in their FAQ that donating did not do anything to increase your ratio
