Ohio University student claims she was raped. Incident caught on camera

An Ohio University student says she was raped, and the alleged assault was photographed and shared on social media.

Investigators say they have spoken to both the man and woman in the photo, and they are trying to determine exactly what happened.

They say one thing is clear: there were witnesses, and investigators want to speak with them.

The 20-year-old woman contacted Athens Police Sunday night and said she had been raped.

She said the assault happened on Saturday morning sometime between 1 and 6 a.m.

Within hours, photos and video of the incident were online and sparking outrage.

It is the photo that started a firestorm.

It shows a young woman against the window of a bank.

A man kneels in front of her, his hand on or near her genitals.

Along with the person taking the photo, there is at least one other bystander visible.

"You could view that picture and certainly suggest that a sexual assault took place,” said Athens Police Chief Tom Pyle. “You could also suggest other things."

In NJ a few years back a dude at a frat party was invited back to a girl's dorm room and they ended up sleeping together. She woke up the next day, freaked out, called the police and had him arrested for rape. In court she argued she have agreed to sleep with him but she was too drunk to give consent. He did three years. It's scary out there.
 
Yes, consent requires the the person giving it be in a sound state of mind to give consent. The question is, if a man is in a state of intoxication that prevents him from understanding that the person giving consent is in no condition to do so, is he still at fault? Could we end up with a no-fault rape?
 
Take it a step further, Am I in a sound state of mind enough to know I'm too drunk to drive? Imagine every drunk driving conviction overturned because they were too drunk to make the decision not to drive.
 
sorry, I saw the video. She was cupping his his head and ramming it into her groin. I would say assault on both sides. I'm guessing the gentleman might have had a few drinks as well. Isn't it possible that he was the real victim here or is only the woman who can claim she was drunk and get the guy thrown in jail?

Based on that description, no crime was committed other than possibly consensual sex in public.

This is a little different. In driving we can assume that you know you are going to drink, and therefore should have made provisions for you to be unable to drive.

Lets take sex out of this. Lets say you agree to sell me your car for one dollar US.

In case one you are clearly not in your right mind to make such a deal, and I am aware you are not able to make this contract, but I take your car anyway. There is a strong case for me having stolen your car, especially if I manipulated you to get you in a state where you didn't know what you are doing.

In case two you are clearly not in your right mind to make such a deal, but I am unaware you are not able to make this contract, and I take your car. The deal might get negated, given you your car back, but I would not be held accountable for stealing your car.

Tell me, how is rape any different? Does it not all still have to hinge on my ability to know if consent is given?

yeah his life is over. no matter what he is fucked. The girl? nothing is going to happen to her. She can make false allegations of rape and even though video is out saying otherwise it won't matter.
 
Until we know what happened before and after the video was recorded, we don't have enough info to decide whether this was rape or not.
