Again, why care? Rehnquist was the most conservative judge on the court. It's a 1 for 1 deal. If anything, the threat of filibuster will have Bush appointing a less conservative judge.

A black man as Chief Justice? Not that I have a problem with it but don't you think the voters for Bush will have a problem with it? Aren't chief justices traditionally white like Presidents? If Clarence Thomas becomes Chief Justice, it will be one step closer to a black President. As long as they do their job well, I don't really care who is president or chief justice.

I'd vote for Condy for president...and I think conservatives would rather have Clarence Thomas in as well. He leans to the right more plus he is younger so he should last awhile.

Thank God Congress found a way to stop this from happening. They will not provide any highway improvement funding if any state uses imminent domain to build malls, shopping centers, etc.

He's partly right. Rehnquist was going to have to stepdown soon as well due to health reasons. If he did this during a Republican administration, the repubs could get a younger guy to replace him for the next 20-25 years. Thomas is 12 years younger that's why I think Bush will tap him as the next Supreme Court Chief Justice. He's only 57 while Scalia is almost 70.

I didn't say there was going to be a lost for conservatives. A Supreme Court Chief Justice nomination happens only once in a long time. It's going to be a greater headache to get a Chief Justice confirmed....let alone an associate justice like John Roberts.

The CJ does make a slight difference. The CJ decides who writes the opinion. Sometimes the dicta in these opinions is used by advocates in lower courts.

Again, no big deal. The vote is already decided, and the CJ has no influence over the vote. The big deal here is the new appointee, and in this case, it's a wash.
