The fact is, it is a premeditated act, with the intention of causing physical harm for the purpose of revenge. How exactly is this different from other acts of premeditated assault? Do you think she would have sex with him if he told her "I want revenge on you for breaking up with me, so I'd like to have sex with you while you're drunk, hard enough to tear you up"?

The only way I'd agree it was assualt is if she told him to stop because it was hurting and he refused to stop. Otherwise, she CHOSE to drink with him and CHOSE to have sex with him.

OP - I've been That Guy. You know, the one you're being asked to be? That's a sucky place to be. If this girl was in your life for 6 years, then jumped ship to hook up with Johnny the Pool Boy or whatever... and doesn't really have a constructive-for-you-both place in her life for you... and then when that romance blows up she wants to come cry on your shoulder, you are being used. Plain and simple. You have to decide the role she can play in your life, but I'd ask if you think this will really help you out? I mean, you could hit yourself in the hand with a hammer. Some people may want you to -- but is it a good idea?

Mind you, if you aren't going to be the comforting chump... I mean, old friend to help put her back on her feet, then you'll probably get some verbal abuse for it. Probably the words "cold-hearted" or "bastard" will come up. Bonus points if some of the more hurtful points of your breakup are re-dredged and thrown in your face. But you have to watch out for your own emotional well-being. Apparently she wasn't so interested in your emotions when she bailed on you; so can you come up with a real reason why you should be overly concerned about picking up the pieces for her when her Next Guy After You didn't work out?
