OEM software question for Roxio EZ CD Creator(mod might help on this)

I have a pulled 12x8x32x cdrw drive from a dell pc, the guy gave me the "dell" oem copy of Roxio 5.2, the liscense says it belongs with dell computers, but if he uninstalled that copy and traded me the only component that uses it, would I be in violation of software liscensing or not by using it on a non-dell pc? it seems very grey, but I know you can take a "dell" copy of Win9x and install it fine, without the worry of liscensing, because of microsofts liscensing as long as the os is only installed on one machine per liscense, you mearly have the selling bit of selling a piece of hardware with it.

shouldn't that be the same with the roxio software or are they laywers bs just getting to me?
