OEM OS question

I want to buy either Win2k or WinXP, and I've been looking at those OEM prices. I've heard people say that it's legal for resellers to sell OEM software as long as it is sold with hardware (I may have even heard people specifically say it needs to be sold with a hard drive or motherboard). Is this true? And if so, could someone please show me where (if anywhere) it says that on the Microsoft Web site?

I remember hearing something about this a while back. I believe it is considered "Grey Market" software. The vendor is supposed to sell the software with a new computer only. I have had a few laptops over the years and the OEM CD that came with them usually says "For Distribution with a NEW PC only".
 
I wouldn't worry about it, as long as it is a genuine disk, complete with COA, serial, etc. The liability, if there were ever to be any, would fall on the vendor, not you. 😉
