OEM Licensing question

Quick question about OEM licensing.

Scenario:

If I purchase a Dell pc with Windows 7 Professional 32bit, under the OEM license, am I able to legally install Windows 7 Professional 64bit using a Dell OEM disc?

I know with retail, both versions are included.. I just want to know if the license covers both versions in an OEM license.

Documentation to support your stance on this would be great (as it is actually to protect my clients)

Yes, but only if the install bits are supplied by Dell. Its a tiny stipulation that Microsoft actually doesn't care about.

The easiest way to do it would be to use a Dell OEM disc. You may be able to obtain one through support or the sales dept.

For retail and KMS activation, they use the same key for 32 and 64 bit versions so it seems that having a license for specific edition (Home, Pro, Ult) allows for both 32 and 64.
