OK, I hate to start a new thread on this topic, but this development deserves its own spotlight. I think it's finally safe to say that Obama & Co. have completely detached themselves from the American people on the immigration issue and simply don't give a shit anymore. It's fucking disgusting...

The Obama administration is asking the Supreme Court to overturn an appeals court decision that upheld Arizona's right to punish employers for hiring illegal immigrants.

The Arizona law gives the state the right to suspend or terminate business licenses.

"If you hire a person in this country illegally knowingly, you'll lose your license. First offense, 10 days. Second offense, revocation, never to do business in the state of Arizona again," said Arizona state Sen. Russell Pearce, a Republican who helped draft the new controversial Arizona law that cracks down on illegal immigrants.

The Obama administration apparently worries letting that law stand would leave in place a precedent that states have a legitimate role in enforcing immigration laws – a notion the administration fiercely opposes.

"The argument that the Justice Department is making here, is you know, the fundamental question, which is where does state authority begin and end when it comes to federal immigration law?" said Benjamin Johnson, executive director of the American Immigration Council.

The Arizona statue relies on a law passed by the U.S. Congress in 1986, which made clear federal law preempts the states on immigration – but left one exception: "The provisions of this section preempt any state or local law imposing civil or criminal sanctions (other than through licensing and similar laws) upon those who employ unauthorized aliens."

"Congress said very clearly that licensing and similar laws can be used to impose consequences on employers who hire unauthorized aliens at the state level," said Kris Kobach, a law professor at the University of Missouri, Kansas City. "And that's exactly what Arizona did."

Oddly enough, the law in question was signed in 2007 by then-Gov. Janet Napolitano, now Obama's Homeland Security secretary. Not only that, but the law was upheld by the 9th Circuit Court of Appeals in San Francisco.

"And bear in mind that 9th Circuit is generally regarded as one of the more liberal circuits in the United States – and so the Obama administration, evidently, believes that the 9th Circuit views on this question is too conservative for this administration," Kobach said.

And this is yet another issue in the ongoing tug of war between Washington and the states, especially Arizona.

"The idea that states can't be involved in immigration law in any way is wrong," Johnson said. "The states have always had a role to play in immigration enforcement. The tricky part is defining where that authority begins and ends."

So of all the aspects of the law to target, they chose the one that's already legal and confirmed by federal law? Explicitly? I don't know much about the supreme court, but Obama must have some serious friends on it if he thinks he can pass this.

In the meantime, once this gets out I see his approval rating dropping another couple of points.

If ICE, ie, the Federal Government, was doing its job, the States wouldn't have to take actions. Its a given that companies that break the law should be punished.

I have little doubt that if the Arizona Governer continues what she's doing now, we'll have our first female president in the White House in 2012. She's doing what the people want her to do. That's how you get elected by a land slide.

That's what I was thinking. VP maybe anyway. If the "up-is-really-down" Dem crowd think Palin was a threat Brewer could really steal the show

They're as detached from the American people on immigration as the previous administration was on the American's people's feelings on Iraq. So the faux outrage over what the American people feel on an issue is entirely transparent. What really matters is what's good for the American people (not saying Obama's stance on this is justified though).

I read an opinion piece earlier this week in which the author stated the reasons he felt Obama would resign before the end of this term. Some of it was quite credible and some was kind of out there so I didn't create a topic here around it. It would have been an epic thread though.

But anyway it gave me hope for change.

This guy and his hand picked crew of keystone cops evidently don't give one iota of a flying fuck about public opinion.

I'll be more than happy to help hold the rail that runs this dictator wanna-be out of town. The sooner the better.

Same goes for those hiring them, they are criminals too. IMO going after those that hire them is the best way to deal with this problem. If there's no work for them then there's no reason for most of them to be here.

Obama's got it wrong on this one.

Although I do admit, I do receive a certain amount of enjoyment watching Obama flailing and continuing many of Bush's policies while the usual suspects here either turn a blind eye or defend him to the end.

These things are pure politics. The issue is not the point. Its all about posturing, looking competent, looking "presidential". Nothing is going to be solved here. Its just an excuse to stay in the news. Obama is pandering to the latino crowd again, because next election it wont be enough to simply give campaign speeches in Spanish. He's gotta try to look pro-latin, and while he doesnt need to actually accomplish anything, making feeble attempts will probably be enough.

Personally, I am hoping this alienates the majority of Americans and at the same time makes illegals realize they will not be helped by anyone except an unpopular president. As for legit immigrants, I want them to know that no particular race or group with receive special attention or help. Legally or illegally we are not turning this country into the Unites States of Mexico.

Much like those who defended Bush but are railing against Obama for doing the same thing.

All I can say is that I'm starting to become very disillusioned with Obama and the whole political process. I was really hoping that in Obama we'd get somebody that would pull us out of the mess Bush left us in but it seems it's the same shit.

I truely wish Texas would pass the same law to punish those who employ the illegal immagrants. I have a neighbor who lost his job around a year ago. This spring he started helping his teen age son mow lawns to make money for the family. I normally do my own yard work, but to help out I have them do my yard. I pay them $40 for mowing and edging the yard each week.

A couple of weeks ago, not 20 minutes after they were finished and had left, a lawn mowing company pulls up, the owner gets out and comes to talk to me. He noticed that I was having my yard done and asks how much I pay. I said I'm not interested, but I pay $40. He has the balls to say, "Look, I've got 5 Mexicans (points over to his truck), we can have it done in 15 minutes, and I'll only charge you $30". I ask him if he has a card, and he gives me one. I said, "Thanks, now that I have your information it will be easier to turn your company in to the INS." He had the strangest look on his face like I was nuts. Then he laughed and said, "Yea, I hire illegals and good luck with turning me in", then he laughed again. I told him to FUCK OFF and get off my yard or I'll call the police and have you removed for trespassing.

I've seen this company doing a couple yards in the neighborhood, so I posted an email to the HOA basically giving them the same information I'm telling you. I also went and talked to the neighbors who had hired this company. Both have now hired the father and son to do the yard work.

If you truely believe that hiring illegal immagrants doesn't hurt our society, especially when times are tough, you're sadly mistaken.

Unfortunately a lot of those who complain about Illegals have no problems hiring them to do their lawns to save money.

Yep, Obama's on the wrong side on this one. But lets be honest here, the law has been on the books since 2007 and went into effect 2008 and ZERO companies have been prosecuted under this law by the AZ AG.
