Tonight, Barack Obama will host ten House Democrats who voted against the health care bill in November at the White House; he's obviously trying to persuade them to switch their votes to yes. One of the ten is Jim Matheson of Utah. The White House just sent out a press release announcing that today President Obama nominated Matheson's brother Scott M. Matheson, Jr. to the United States Court of Appeals for the Tenth Circuit.

Is there a problem with the qualifications?

Presidents many times make appointments to the circuit and appeals court based on political choices.

As long as the person is qualified, it is the decision of the Senate to then confirm the choice

This is a pale version of the uproar when JFK appointed his brother as Attorney General. Bobby ended up being one of the best and most effective AGs ever.

Now that's some perspicacious insight! I can't imagine why the POTUS would try to persuade anyone. The nerve of him...
