He never told any jokes. The laughter was because of the republican reaction of not wanting him to appoint anyone. Scalia was never brought up or insulted in any way.

It wasn't. And even if it was, Scalia would probably be one of the few to be ok with it. To sum up his stance on himself, just look at the video of Colbert did about Scalia after he passed. Scalia was probably one of the few who had no problem with jokes at his expense.

The humor, of course, was that he not others has a problem appointing judges, a difficulty he laughs about because there is nothing else to do but laugh.
