Also, could she possibly believe almond oil doesn't fit into the "allergy to nuts thing" (how the GF probably saw it 😉).

no, might be negligent homicide.


edit: if someone switched the labels without having any idea dude is allergic to almonds, no level of the homicide spectrum covers that.


edit2: voluntary manslaughter is generally due to either imperfect self defense (too much force used for the situation), or the old man-walks-in-on-spouse-cheating-and-kills (which is going out of favor as it's really rather misogynistic).

involuntary manslaughter is where there is an unintended death due to an intended unlawful act, such as running a red light and killing someone in a resulting accident.

Sounds like an accident. Now it is their fault for not making better labels, or the person who switched the labels, or hell we can blame him for not reading the other side of the pitcher. It is all about point of view.

What if his GF accidentally put some almond oil in his beverage, he drinks the beverage, swells up, and chokes to death. Can they charge her w/ anything? And what degree would it be?

I think that's the key there.

He gets Murder 2 also as an accomplice if she goes down.

I would suspect that in the scenario; it would be charged to Murder 2.
Murder 1 usually requires demonstrable Motive. This has none.

Baked would get the same because he does have a motive - clear path to the GF and being an accompliss

Seriously, you gave a detailed scenario that isn't norm. You brought up a discussion about someone being killed through a serious alergic reaction. I don't think this should be just brushed aside as some random bs talk. If I was admin, I damn sure would pull your IP just for safe keeping. Because you sounded like some kind of a nut.
