I was driving on a 4 lane road to work and was in the right lane. About the only other car around was the SUV in the left lane. All of a sudden the SUV leaves his lane and hits my car around my rear driver's side tire - causing me to fish tail slightly. And the fucker just speeds off down the road. Fortunately my car still felt fine so I followed him. I have no idea what he thought he was doing - we were headed into an area that is always heavy rush hour traffic with no nearby intersections. So I called 911 to report a hit and run and quickly caught up to him after he got stuck going about 25mph.

911: "Did you get a description of the vehicle?"
Me: "Yeah I'm right behind him in traffic. What do you want to know?"

Its still 2 west bound lanes so I pull up beside him for a better look. Asshole just looks over at me and flicks me off while I'm on the phone with 911.

So they got license plate #, car make model and color, bumper sticker, description of driver, color of jacket, and color of hat

Once it was clear he was never going to pull over I found a carpool lot and waited for the cops. The damage to my car isn't too bad but he hit me like 5/6 of the way back so either he didn't like me passing him on the left (passing on the left is common in MI) and decided to hit me or he wasn't paying attention

Sadly it seems the ticket for a hit and run when no one is injured is only $100. (A speeding ticket for 1-5mph is $95). I can only hope it comes with a lot of points.

Now I have to figure out if there is anything I can do to get him to pay for repairs without making a second car insurance claim in 3 months. (MI car insurance is super fucked up) It also pisses me off that I went 12 years without even a fender bender and now I've had two accidents in 3 months that are very clearly not my fault. I know everyone says drivers in their area are bad but the area we moved to 2 years ago might be the worst in MI. We have some of the most dangerous intersections in the state (Which are 4 way intersections with traffic lights) despite competing with much higher density areas like Grand Rapids. Part of the problem is the auto industries draw a lot of people from areas that don't get snow and, for some reason, our area has a larger than average concentration of that.

Did they issue a ticket to him and give you an accident report? As part of that they should have gotten his insurance information to give to you I would think.

Not yet since they have to find him. They have his home address and the cop was going to stop by his house but he was probably on his way to work. I do have a Crash Report # and should be able to get that info once they get it from him

The guy would have to pay for car repairs. You did file a police report?

MI is a No Fault state so my insurance is involved in the claim\repair process. From my other accident I know I can file a mini-tort to cover my insurance deductible and as long as I am <50% at fault he has to pay for that out of pocket but that might escalate to a small claims court case (which it has for my other accident). The damage isn't terrible so I'm wondering if I can just do the mini-tort and use the $ towards the repairs. Yeah I have the police report # but I'm sure its incomplete since they have to find and get the information from the guy who drove off

Do it, and hope it escalates. Since the POS apparently didn't have the time to give you the courtesy of a stop, taking away as much time (and money) as possible from him seems appropriate.

What does that mean? Are you saying the idiot isn't at fault or doesn't bear any responsibility? I'm not a lawyer.

My insurance pays for damage to my stuff regardless of who is at fault. I can file a legal claim against the at fault driver to cover my deductible.

What a dick. He even had the audacity to flip you off? Maybe he thought you were banging his wife?

Agreed, although I would prefer not to have to go to small claims court again

Hmmm....pretty weak response for that.

I thought hit and runs come some jail time and suspension of license? And God help you if you injure or kill someone.

(not joking here - that actually happened)

Well, with you driving an M3 that's probably the best he could muster, being all jelly and all.

He was probably too distracted trying to figure out why my M3 had toyota hubcaps :D

Yeah I was very surprised it was so little

257.618 Accidents; damage to vehicles; stopping required; reporting to police agency or officer; penalty.
Sec. 618.

(1) The driver of a vehicle who knows or who has reason to believe that he has been involved in an accident upon public or private property that is open to travel by the public shall immediately stop his or her vehicle at the scene of the accident and shall remain there until the requirements of section 619 are fulfilled or immediately report the accident to the nearest or most convenient police agency or officer to fulfill the requirements of section 619(a) and (b) if there is a reasonable and honest belief that remaining at the scene will result in further harm. The stop shall be made without obstructing traffic more than is necessary.

(2) If an individual violates the requirements of subsection (1) and the accident results in damage to a vehicle operated by or attended by any individual, the individual is guilty of a misdemeanor punishable by imprisonment for not more than 90 days or a fine of not more than $100.00, or both.

I've heard first offense is the $100 fine. Second plus likely gets you some combination of both. Injury\death is a fine up to $1000 but then they add harsher charges like vehicular manslaughter

That could happen any where if the dude hit has warrants, is in a stolen car, is drunk, has 50 kilos of meth on him, etc.

I saw a hit and run last summer. I'm sitting at a red light, chick pulls up in the left turn lane, decides she doesn't want to turn left and starts backing up. I watch the whole thing in my mirror, as a car starts heading to the left turn lane, I'm oh oh she might have...crunch. She gunned it back in drive and flew threw the red light. I was in my box truck or I would of gave chase, luckily some other kind fellow ran the red light after her.

Looks like tire rubbings is there any dents? I had a datsun swerve into my lane and he sort of bounced of my car and it knocked him back. I stopped to check the damage and all there was was some blue paint on my tire.

The fine at first offense should be $1000 to make it hurt, so folks will take this seriously.

Eh I figured illegal immigrant, was a beater old suburban. Driving extra cautiously, which is why I hit him on a right yield turn where the dumbass completely stopped with no cars coming.

I wish. The darkest black areas on the bumper is the plastic itself as the paint is gone for most of that. The car body panel above\around the tire has some areas where it is gouged down to the metal and I think that is also true along the door edge

Can you make this a poll?

Sure

He was trying to use the PIT maneuver on you but didn't fully commit.

Thats how I've been describing it to people
