I have a laptop with genuine windows 8.1 pre-installed. I want to update it to windows 10 but is unable to do so. The problem is as follow.

When I go to PC settings --> Update and recovery --> Windows Update, it keeps on searching for updates for much longer time but did not shows any updates available. It did not comes out of this state even after much time.

For other way I also downloaded windows 10 installer from Microsoft windows website. But when I run it, it shows the popup every time as "There was a problem with the setup tool. Please restart and try again" . I tried re-starting windows multiple times but same thing happens.

Also few days before I accidentally deleted the default recovery partition in the laptop. Is this the reason for not able to update or there is some another glitch ?

I want to update to windows 10 without losing any data. Please help.

"There was a problem with the setup tool. Please restart and try again" .

Instead of using that Microsoft tool for creation of the Win10 installer USB thumb drive, try Rufus.

Note: also a good idea to first make a complete backup of the Win8.1 boot drive. Then delete the existing HD partitions during the Win10 installation preliminary setup, and create a new partition from the unallocated HD space.
Of course: an in-place upgrade from Win8.1 would be more convenient, but if that again fails while using the Rufus created installation medium, you'll need to re-try with the complete re-format method.

When I first tried to install W10 in my Lenovo T510 laptop, MS said it was not compatible with W10. So, I used the MS tool to download the ISO file for W10. I then used it to create a bootable media - in this case, a DVD. When I tried to install it, I got the same message. So, I suspected a glitch by MS, and confirmed it online. So, I then disconnected the T510 from the Internet and the installation went perfectly.

That was last year. Since then, the T510 has thrived on W10 and accepted many online updates. So, if you have W10 on bootable media, disconnect from the Internet completely and try the installation so that there is no interaction whatsoever until after W10 is installed. That worked for me.

BTW, in keeping with vailr's comment, I first cloned my OS drive and thus had a full backup in case of a failure.

Be careful doing this. Simply using your windows 8.1 security key will not work when you delete the partition and start the Windows 10 setup. If you can't install Windows 10 I would call Microsoft and have them give you a security key. You'll more than likely have to go through the upgrade process with them, and when it doesn't work they'll validate your windows 8.1 security key before providing you a Windows 10 key.

Selecting the "Do not check for updates" check box during the Windows install process, should (theoretically) act the same as disconnecting physically from the internet.

The MS media creation tool has always worked for me when WU fails to install 10. Let it create a bootable thumb drive for you or do the iso thing for an optical drive.

That is true, however, there is other interface that takes place initially. I trust hardware solutions much more than software ones. :) Pulling the T-plug on the laptop was foolproof, and guaranteed.
