My experience is that T-Mobile doesn't require a data plan on an iPhone for either their prepaid or contract plans. AT&T generally does require it on their contract plans, but are less restrictive on their prepaid plans.
You don't need a data plan on either network if you disable the data on the phone... If you use data you obviously need a data plan, but not if you don't.

The problem with AT&T is that they regularly scan their network to check for phones so you could get away with it but most likely they'll catch you and automatically add data to your plan.
