He may have let them use the graphs. AT is pretty much known all over the world and he may actually be honored that his graphs are used. Why does everyone in this country just want to sue sue sue?!?!??!?!
Most visitors would not recognize those graphs as originating at Anandtech; probably many Anandtech readers would not. Without at least an AT logo, it doesn't exactly do a lot to promote the site.
Most reasonable people that derive their income from producing intellectual property are not happy to have someone rip off that intellectual property, rebrand it, and give absolutely no credit. You have noticed that many sites (including Newegg, Tom's Hardware, etc.) watermark their images, right?
Hardspell does have some pages that mention (but do not link) Anandtech, but they appear to be mostly or all in Chinese. I found exactly one with an actual link,
here. If they have a relationship with Anandtech, it doesn't appear to be an especially fruitful one for Anandtech.

I *think* hardspell is in China. Good luck getting a court order over there.
Whois indicates all the registration contacts and the IP of the server are in China, so yes it would be difficult to pursue any kind of legal action.
