Yeah, awesome. I don't understand how this shit gets by the courts. This and their stop and frisk bullshit are pretty clear violations of the 4th Amendment. I really can't wrap my mind around how that city gets away with this kind of shit.

As soon as the nypd arrest someone from illegally packing... And this person has the means to defend themselves in court... I don't see how it would stand up.

Is this something that is used at random or just something that is used after the popo witness a crime?

You know, I get that NYC has been through a lot and they are a huge target, but the L.E. authorities there are losing it. I don't throw around the term "police state" that often, but when so many officials are so bent on security at the expense of liberty and common sense, it's going in a dangerous direction. And I'm not just saying that because their top cops are gun control nutters.
 
So is it x-ray? (doubt it) It looks to be infrared and can detect heat differences. Subjecting an unknowing person to a radiation dose sounds like a recipe for a huge lawsuit.

There has to be a balance between public interest and personal interest and the balance is shifting wayyyy too far to public interest to such an extent that it is getting ridiculous IE flirting the constitution and frivolous laws, like the soda ban.

Take public interest to infinity. Instead of food stamps it would be better to place the unproductive in concrete prison camps. There ya go, perfect world order.

Don't get me wrong, Republicans would love to do this sort of thing. But given the propensity for Democrats to whine about the Republican fascists and the evils of the violent right wing, why do these kind of Orwellian scenarios always seem to happen in Democrat strongholds first?

Authoritarianism is found in all sides especially for those who have a vested interest in expanding the size and scope of government in order to retain and hold political power by offering up a false sense of "hope and change" and free ride at other people's expense/liberty.


Thus Libertarianism is the best and only cure for those seeking freedom from these people.

My previous post was simply characterizing NYC's argument. I don't subscribe to NYC's way of thinking. I'd prefer a complete anarchy as government has proven itself time and again to be completely inept.

You realize x-ray scanning would require a target on the other side? This is essentially a more targeted type of infrared imaging device. Something law enforcement has had for years.

If they try to use this without having already stopped someone for reasonable suspicion then it will get struck down in court. This is a smaller example of the supreme court ruling on the infrared search of someone's house to find weed growing operations, Kyllo vs US, which said it's banned by the fourth.

Honestly OP please fix the thread title, it's completely disingenuous. Not that I think random thermal imaging without probable cause is a good thing or legal, but this is a RT article which is a toilet of a news agency so I'm not even sure they plan on doing that.

It has not gotten by the courts, there are multiple cases challenging the legality of the law.

As to how the city gets away with it that is due to politicians ignoring their oath to uphold the Constitution that they all take when sworn into office. They are supposed to not pass laws they suspect will not stand up to Constitutional challenges yet they do so because it helps them politically and if a court eventually overturns the law years later they can then demonize the courts. It is a game played across the entire political spectrum whenever that pesky Constitution gets in the way of momentary political demands.
