according to your rules this vote should not count it was putted after 10pm eastern time when you said day will end. you also state day will be prolonged if conversation is happening and there was no conversation. so this vote is not valid and must be excluded.

well if i am that of a lawyer and it is all about the fun
then hamburgerboy and psyjsay vote should have been permited to be accepted. not that they were going to change anything from 1-1 tie to 2-2 tie but why not accept those messages also??? more or less press submit button the same time 😛
