need some ebay advice

yep, i agree with that. it ifs not stated that its NEW, UNOPENED, it is up to the potential bidder to ASK the seller if its new or used. also if sellers are selling something NEW, 99.99% of the time they will state NEW in big and bold in title and everywhere rather than say nothing about it being used or new.

his shippings costs were clearly stated, and his tax was clearly stated. if the bidder didn't want to pay 10 bucks for shipping and sales tax, DONT BID. its that simple people. and most likely the bidder added in the final cost after shipping and tax.

so dionx, tell him that its as is, its a used copy. tell him about the atari forums.

Well, it's what I see as standard on eBay. I'm a professional ebay seller (99% of the things I sell is new) for years and I've always seen this standard on eBay. Just do a search on eBay and look for yourself. If it's new, they're going to say something in the title and most likely the description. If it's not, they don't.

Have you read through the posts on this? I don't disagree with you at all. I was just making an observation of the shipping costs when people were figuring that into the refund. I buy from auctions that factor that into the price (as I said), but I'm just commenting on this particular situation and the bottom line is that is against Ebay regulation whether or not we like it or abide by it. Nowadays, it's not about playing by the rules, its about making the most money and pocketing as much as you can, so I'm stating the rules more than opinion.

Plus when you add it up it doesn't come to $10 it comes to $10 + $2 + sales tax (which there is no evident the seller is entitled to charge).

Second, the ISSUE IS NOT THE COST of sales tax, the ISSUE IS WHY A PRIVATE INDIVIDUAL SELLER IS CHARGING IT!! You can't just charge sales tax and pocket it, that would be not only dishonest but illegal as well. I'm wondering what explanation he has for charging it since he points out that he is not a busniess.

Additionally, you can't just "tell him its as-is" after the sale. I can't sell you something and when it arrives broken throw in, oh yea...that item is as is.

isnt all income generated suppossed to be reportable to the IRS? and if that income is generated by ebay, if i were to get taxed on that shouldnt that be passed on to the consumer. i'm suppossed to withhold my own taxes right? such as i tutor on the side in addition to my full time job. i generate $25 or $30 an hour and that adds up. the tutors pay me directly. i'm suppossed to and do withhold taxes for that. shouldnt i not do that for my ebay auctions? isnt that what the 1099 forms are for?

dionx pointed it out after this post. any income generated whether it be from ebay or not, is taxable. so sales tax can be charged to consumers. some sellers do, some sellers dont, but remember this figure goes to the bottom line price. so i the bidder sees this sales tax, i add it in to the final price, and bid accordingly.

i never said its as is after the sale. where in his auction did he state about guarantees??????????????? none. therefore its assumed to be as-is. buyer beware. you DONT have to state "as-is" all over you auction to state as-is, as long as you don't give a guarantee, its AS-is. just like you don't have to state USED all over your auction, as long as its not stated to be NEW, its most likely USED. if you arn't sure, then email the seller. difficult?? no
