need some advice on a transaction from fs/ft ...

i bought a 1.4 ahyja tbird from a person whom i'll call "joe". in joe's post on fs/ft, he says he upgraded to an xp, so he is selling the parts from his old system. he says the chip was never o/c'ed. i'm like...cool...pretty good price, i'll buy it. i paypal joe and the chip arrives at my house promptly. now, at that point, i did not have a hsf good enough to keep the tbird cool, so i was not able to test it out yet. but one thing i noticed about the tbird was that it was chipped. i was a little concerned about this, but being i had no hsf to test the tbird, i posted in the cpu forums inquiring about chipped cpus. some ppl said chipped cpu's can still be good...so i wasn't quite freaking out yet. i pm'ed joe and asked if he had any problems with the tbird, becuz it has a chipped core. joe apologizes and tells me that he did not realize the core was chipped, and reassures me the cpu is working, and was never o/c'ed though he planned to when he got it. basically, i didn't care as long as the cpu works. so i patiently waited for my sk6 to come in and a few days ago, it did. to make a long story short, the tbird does not work. it does not post...my monitor does not even get a signal with the tbird in. i put my old duron back in and everything is fine. so i pm joe and tell him the cpu is dead, and asked if he had another cpu, or could he refund my money. he doesn't have another cpu, as he put it "For the refund thing, I am very sure that I sent the right and working proc to you. So at this point, I don't know if I should refund the money to you". i pm joe back and told him it didn't work for me, and offered to send it back to him for him to verify its condition. that was 1/18 in the afternoon. i know joe has logged in since then, but no reply. if you were joe, wouldn't you want to get this situation resolved asap? i have not gotten a reply, and i am a bit eager to get this situation resolved. being i live like 1500 miles away, all i can do is sit and wait. so as i sit here, i check out joe's heatware and ebay. i'm impressed that it's spotless. so just becuz i am bored, i look up joe's profile and look at his rigs. apparently, joe's last rig update was in late december. his rig at that time had a 1.4 ahyja tbird @ 1.6 :Q could that be the same never o/c'ed cpu i was sold (i took a screenshot...just in case)? i really don't know if i should send the cpu back to joe, becuz he could just send it right back to me and say it works. would it be out of line (assuming joe agrees)if i asked an established trader on these forums to be intervine and allow me to send them the cpu to test? i know its a little early and i might be overreacting, but right now, i am out $100 and for a college kid, it ain't cool. what do you guys think i should do, or can do?

Edit - i recieved the cpu on 1/9 and recieved my sk6 on 1/18.

Edit - i bought the cpu on 1/4 (paid by paypal) and the hsf on 1/7 (paid by MO)... i could link the posts, but they've been editted and also "joe" would be revealed.

Edit - well, i can see joe logged in early this morning, but still no pm reply from him :(

There is an implied DOA warranty. You should send it back and he should refund.

if he didnt tell you there was a chip on the processor then he should take it back.

He sent you a dead chip it seems, and the chipped core is bad enough, I guess there is no way to prove the oc'ing of the chip but at this point it doesn't even matter. If its doa it is his job to take it back.

If there's chip on the Processor and he didn't tell you then he owes you a full refund. There is precedent of this at the For Sale Forum and in each and every case the concensus was that the buyer should get a full refund. Give him ample time to refund you the money as he may not have it.

i know, but it seems awfully fishy. he sold me a 1.4 ahyja, becuz he replaced it with an xp. i got a dead cpu and request either a replacement or refund. he says he does not have another cpu, but what about the one that is described in his rig page (the 1.4 ahyja @ 1.6). if he does not have 2 ahyja's, then the 1.4 @ 1.6 is the non-o/c'ed cpu he sold me. in a way, i just feel like i am being jerked around, but i supposed i need to allow a little more time for joe to give me a fair reply.

Hey GUY, you better not fool with SpankyOO7, give his money back or be considered a TROLL!!! At least reply to his PM's when your logged on to AT. I smell something fishy!!!!!
