Need some advice.....got screwed on egay

Not really sure what i can do about this but here is my situation. I ordered a PS2 on ebay last week and according the description it was a new unit. So I bid on it and eventually won it. I paid for it and got the unit 2 days ago. When I opened the package i noticed that the PS2 was not "New" like indicated. The box's seal had been broken and I could tell the unit was removed. I figured it was no big deal as long as everything else was intact. However, when I pulled the PS2 out of the box, the "Warranty Void if Seal Removed" sticker was tampered with. So I promptly wrote to the guy I bought it from, telling him that this PS2 was not in "New" condition because the seal was broken. He also nowhere in the auction description stated that it was. He wrote back saying that he didn't know what I was talking about and that I was in New condition. Apparently he purchased it from someone on egay and he just tested it and resold it (whether i believe that or not i don't know). now the unit was operational but that isn't exactly the point because for a little more money i could have bought a brand new unit. after recieving his email i opened it up to see exactly what had been done to it that the seal was removed. i noticed that it was missing half the screws that it came with and the metal piece that covers the motherboard looks like some tried to pry it off with a crowbar. it was all bent out of shape and it's no wonder half the screws were missing because one would've had a hard time getting them in the condition that this thing was in. I wrote him an email later explaining all of this and asking for either a replacement unit with the seal intact or a refund of what i paid and he could have the damaged unit back. that was 2 days ago. he has not written back since. i'm very pissed and not sure what to do. anyone have any advice for me
 
Buy from someone with better feedback next time. That's about all you can do. Ebay is a crapshoot sometimes because you are depending on the person you are dealing with having morals.

 
File a complaint with ebay if he doesn't come through. If they tried to mod it and failed then it could have serious issues in the near future, especially once it's on and gets hot.
 
at least it still works....

but at anyrate, i would never buy something that expensive from ebay...nothing wrong with spending extra to get a brand unit like that.

in fact, i got it from sony's website, which gives me 10X sony points that equals to a $30 game.

love my sony credit card.... i use it for all my company purchase which gets reimbursed... then use the points to get playstation games for free...
 
What was this guys feedback? did he have any at all? Did he have a return policy stated?

Also if his feedback was good what did he sell before? did he say any other Playstation 2 units or was this his first and only?

These are all questions you should ask before buying any high dollar item off of ebay...

Buy From a Good seller with alot, or at least decent Feedback
Buy From someone with a stated Return policy on high dollar items
Check to see what the guy is selling (Yeah someone can have great feedback but who cares if they sold 1000 beanie babys if what you are interested in is a PS2)

Buy the Seller and then the Product...

As long as you do your homework then there are no gambles with ebay, you just have to be an educated consumer
 
well he still hasn't gotten back to me. he had nothing about a return policy and when i bid he had like 25 positive and 1 negative but it was something that he bid on then backed out of. i guess i'm going to give him very bad feedback and contact ebay somehow and see what happens from there.
