is the forcible removal of clothing against consent, physical contact (licking) against consent, considered attempted sexual assault? the acts were forcibly performed while holding the individual underwater against her will. however, there was no overt verbal proposition, and no overt attempt at penetration.

can she press charges? does she have any case?

thanks in advance

- - EDIT - -
holy crap...sorry for the ambiguity. i'm not the one involved! someone did this to a friend...i'm wondernig if she can take any legal action. i'm incredibly pissed

Um, I would say she has a case. Is she credible? How bout him?
Witnesses to the event?

She needs to go the police ASAP. She should have reported this immediately. Hopefully there is a witness, or its gonna be her word against his. He may have a criminal record or history of doing this.

k thanks...i will tell her to go to the police. i guess they will give her advice on how/if to proceed

Like I said, report this asap. This person may be a sexual predator. He may have a record. If so, the police will arrest immediately. If anything, it will put pressure on him. If the D.A. feels it warrants an investigation or pressings charges they will do so.

Is she underage or an adult? If underage, they may take this more serious as that would be a high priority for the police. As an adult, not much of a priority unless the guy is a known sexual predator.

Even if he's not a known or registered sex offender, at least he will have a report of this and if it happens again to someone else the police will see a history of this type of reports against him.

If they find he is a sexual predator, and trust me Houston has a lot of them, he is in definite trouble.

Chances are if he was bold enough to do this at a public pool he has a history of some type. I guarantee that, or he has done this to someone else who didn't report it. Get your friend to report it.

I legally can't do anything since I work in the CJC, but I can ask around for someone that can.

Thats a smart move. So many ppl are ashamed or scared to tell the police what happened and this results in nothing happening to the sick fvcks. In turn, they get bolder. They (the predator) begins to feel confident that no one will report them.

They use sick mental crap on ppl too.... telling thier victims no one will believe them. Or, they physically threaten them, using fear to keep them from going to the police.

Its best to let the police know. This will alert the police to this person and they may start watching him.

So many things like this go unreported and its sad, cuz the next victim may not be able to talk!

There is a lot of mental and emotional shock to being violated like that. Most people try to repress or ignore the memory without dealing with it. Reporting it is dealing with it AND letting other people know that it has happened. That adds a shame factor to the equation. They don't deal with it thinking it will go away, but if they don't deal with it, it becomes self destructive. They start to think it was their fault in the first place.

There is a lot more involved in just telling someone. GhettoPeanut, you shouldn't judge your friends chances are they need someone to support them and coax them into reporting. They know it is better to report, but they are ashamed.

The best thing to do is coax her into telling the police. She needs to know that there is nothing to be ashamed of. She is really doing a favor to all of the people that this guy may do it to after her. She is also stronger than any of the people who didn't report this, and trust me anyone that bold has done it before. Be as supportive as you can. She needs to report it or it can lead to serious mental trauma.
