is the forcible removal of clothing against consent, physical contact (licking) against consent, considered attempted sexual assault? the acts were forcibly performed while holding the individual underwater against her will. however, there was no overt verbal proposition, and no overt attempt at penetration.

can she press charges? does she have any case?

Um, I would say she has a case. Is she credible? How bout him?
Witnesses to the event?

She needs to go the police ASAP. She should have reported this immediately. Hopefully there is a witness, or its gonna be her word against his. He may have a criminal record or history of doing this.

there were two otehr people at the pool, but they left before the incident happened. so no witnesses 🙁

and yes, she is credible

Definitely sexual assault.

If it was a coworker, even outside of company, get HR involved. If not, get her to press charges.
