need help on a paypal dispute i requested

well i bought a dual core cpu from a guy on anandtech and i havent gotten anything and the moderator told me to file a dispute well i got an email saying this from paypal:

Because your seller has not yet
responded, you should consider escalating to a claim soon to ensure that
your case remains eligible for PayPal review. By escalating to a claim, you
are asking PayPal to review the case and decide the outcome.

We will assume that the dispute is resolved and will automatically close it
unless you log in to the Resolution Center and escalate it before Apr 29,
2008. A closed dispute cannot be reopened or escalated to a PayPal claim.

should i go ahead and just escalate the claim?

I just had to do this as well for my wife...bought a phone from a guy with 100% feedback, and now she's the 3rd or 4th person to not receive her phone, or have any contact. I have since escalated this to a claim, and I actually found the guy on myspace. I don't know what if anything I can do with that, but he's some 17 yr old thug from near Atlanta. Ugh that makes me mad.

He has not responded to the dispute or claim as of yet... I filed on the 20th, so if he doesn't respond within 10 days, do we "win" the claim? Will they just refund us the money?

I don't mean to thread hijack but we're in the same boat...some good information would benefit all.

This seems to be the consensus regarding pay pal as of late. What the hell is the point of even using it if you are offered no protection, especially against the most obvious risk of never getting the item at all.

Paypal is scum. Trust me...I do credit card disputes all day for work...and even when they can't come back on us taking the money back per Visa/MC rules...they do and so we have to go back again (at which point they stop or they risk fees). They will do anything not to lose a cent, customer be damned.
