need data recovery software

hmm, first, delete the partition. I recall a quick dosshell software that runs from a floppy, that enables you to recover the partition. During this process, every file that just has the header that it's been deleted will be recovered.

that just happens to be the software i just tried and it worked but i am not sure if i am going to shell out the cash yet, still hoping to find some freeware.

Surely your data and time is worth $80 to recover the data. Chalk it up as a lesson learned and do backups. 🙂

Oh, don't like my idea eh? 😛 Well there's this also Handy Recovery I haven't used it myself, but others swear by it. Not free, but you get a full functioning 30 day trial.
