Need advice on procedures for a DIVORCE

My best friend, who is only 21, is going to divorce her husband of one-year. They don't really have any assets and there isn't much of a fight over who gets what. It should all be pretty simple. Does she have to hire an attorney? If so, what should she expect to pay for a non-contested, simple divorce. Someone said that she had to prove that the marriage couldn't work (i.e. adultery, etc.). That sounds crazy to me. I always thought that if one spouse wanted a divorce that they could file and get one.

Once she hires an attorney, how long does it actually take before the divorce is final?

If she doesn't need an attorney, what is the procedure?

I appreciate the input. She has asked for my help (she doesn't know much about things like this), but fortunately I don't know anything about divorces either. If any of you guys have been through a divorce I would like to hear from you. Thanks.

tell her to get a lawyer, then stay away from the topic. you have to worry about taxes, debt, assets all sort of stuff you would never even think of, but a good attorney will know about. you would'nt do your own heart surgery, you should'nt do your own divorce - to important. welcome to the real world - this will cost some money,

I think you may have to be separated for at least six months before you can get a divorce, though it might vary from state to state.

What's the big deal? If she's separated awaiting an imminent divorce, you can hit it all you like anyway. IMHO. ;)

My ex and I never used a lawyer. We did it all ourselves. In our state you can go down to the courthouse and get the necessary papers to file the divorce without a lawyer. It was not that hard to do. I will say this though, if he gets a lawyer, then I think she should get one as well.

That's pretty much the way I see it too, but she refuses to give it up until the divorce is final. Don't think I haven't tried.

You're headed down a risky road my friend. If this woman was going to get divorced even before you came into the picture that's one thing. But if she is leaving her husband for you, you're in a lose-lose situation. First of all when her soon-to-be ex finds out about you (and he will) be prepared for some retaliation. Maybe not him, but we've all got a cousin we'd call if we need a little "dirty work" done. You know the one who's done a little jail time, always could get you weed when you were a teenager, hangs out at the biker bars...you know the type. Second, I guarantee in three months when you get bored "hittin it" as GodBless said, it won't be so easy to say "Gee this isn't really working, maybe we should see other people". Because she's gonna piss and moan "I LEFT MY HUSBAND FOR YOU AND THIS IS HOW YOU TREAT ME!!!". In fact she'll bring it up everytime you get into a fight. Make you feel like you now "owe" her a life since she made such a sacrifice for you. And if you're a dick about it guess what? She's probably also got a shady cousin who wouldn't mind throwin' a beating your way.

Sorry if I sound cynical it's just that I've been there / done that and in the long run it ain't worth it. Find somebody single.
