I know this is a weird place to ask this, but I can't even think of the right terms to google for this. Here's the run down: (cliffs at bottom for the lazy, entire sordid story below for the bored)
My girlfriend is on internship and moved in with 2 other interns. They all signed a 1 year lease as they had a 1 year internship contract which is required by their respective programs to graduate.
On November 20th (5 months into the lease) One of the room mates said that her step dad was dying and on December 13th she was moving back home to be with her mom and asked my girlfriend and her other room mate to sign a release that the complex had given her to remove her from the lease.
She said that the complex was gong to waive her rent and remove her from the lease, but in order to do so her current room mates needed to release her from this obligation. Both room mates were very supportive but when I read over the paper I noticed that it was a standard release, and the complex confirmed that the two room mates would be responsible for the rent in its entirety if they signed it. I told them that didn't make any sense and that if she wanted to remove herself from the lease she would need to find someone to take over her portion of the rent.
So she has gotten in touch with a lot of people and my girlfriend and her other room mate have interviewed them (5 were in contact, 2 showed up for an interview, one of those was being evicted from her current apartment for non-payment, the other seems like a good enough fit for 5 months) So long story short they have a new room mate to move in by mid-february assuming she passes the credit check at the complex, but here is the issue: the other room mate hasn't paid rent for two months (totaling $1020) and she says that she can't afford it right now because she hasn't gotten paid yet.
This came as a surprise because the way the email made it sound she was living with her boyfriend and working, which sounds a little suspicious since she went home to be with her dying step father. So my girlfriend was casually talking to her room mates former supervisor who asked how her new internship was going. My girlfriend was a little shocked since this girl had never mentioned any thing about a new internship, so she asks what he is talking about and he told her that he got in a little bit of hot water for giving her a good recommendation for her new internship (which is why she moved) when she had only completed 2 months of her 1 year contract. Basically, 2 months before she said she was moving out to be with her "dying stepfather" she had interviewed for and accepted another internship where her boyfriend lives.
To further complicate things, my girlfriend requested information from the complex about who guaranteed this girl's lease agreement (their internship pays $12000 for the year so they had to show that they had external means to pay the rent) and they said "you did" My girlfriend has a very sizable trust fund which she used to guarantee her portion of the rent, and apparently the complex saw that it exceeded the amount of the rent for the year so they didn't have this girl fill out a gaurantor form. Further, the property manager keeps saying things like "cut her a break, her dad is dying" but at the same time, won't drop the rent for her, nor will she let them move into a 2 bedroom instead. I've been in contact with the management company who is investigating the issue, but I don't expect much more than a reprimand for the property manager.
My question is: Isn't there something that we can do to affect this girl's credit? She hasn't paid rent in two months and said in an email that she doesn't think she owes any rent since she doesn't live there any more. It seems grossly unfair that two girls who make $1000 a month should be required to pay rent for someone because she doesn't feel like it.
