Need advice ASAP!

ok, ill try to be short here. Me and another person on the forums traded items (both worth around $300 each)

He gets my item safely, I never got his item which had a confirmation and was insured via USPS, about a month passes so I decide to go through the claim process, filled out all the paper work, gave them receipts etc.

Today I receive a letter stating that the claim was denied because the package was"nonmailable" which is probably bs and that i can appeal.

Now should the sender be responsible for this? ? What should/can I do?
 
seller is responsible for getting the package to you. if it was not delivered it is his responsibility to make the deal right. was this deal done here on anandtech?

no it was on hardocp forums, and I have requested my things back but he tells me its not his fault and wont send anything back.

i would also contact the police from where he lives, he entered an agreement with you and is not holding up his end of the deal

no, if he paid for the insurance he needs to go to post office and fill out the form. was the package ever delivered to you? was it damaged?

Since he mailed the package, he needs to initiate the claim. Not you. If it was insured and it was not delivered, the claim should be a slam dunk for him.

Do you have the USPS tracking number and what does it say when you pull it up?
 
A responsible seller would refund your money/goods, and file for insurance claim on his end. You didn't exactly tell the whole story here.

You said the guy got delivery confirmation and insurance. Did he ever send you the delivery confirmation number?

Personally, I look at delivery confirmation and insurance as something to protect the seller, not the buyer.
 
yes he sent me the confirmation number and the insurance receipts so that i can file a claim which i did and was denied, i requested he send me the receipts so that I can handle it quickly.

no, i filed the claim, I asked him to send me the receipts so i can hurry and do it,

that is news to me, it was always my understanding that the person who bought the insurance has to file the claim
 
Well if the claim was denied because it was "nonmailable", then isn't that the other guy's fault? Even if he denies it, the fact that your claim got denied gives you the advantage.
