A poster at SD reported he already got his NEC $90 rebate from a Jan. 2005 purchase from CIRCUIT CITY. This leads me to believe NEC is sitting on the Staples rebate trying to figure out what to do (or trying to figure out the damage - rebate submission deadline was 2/15
While I believe Staples was not supposed to be an authorized retailer for this rebate as the new Easy Rebate system now processes most mfg rebates, I have little sympathy for them as I've been rejected for rebates when I've not followed the terms and conditions. Since the T&C don't exclude Staples I fully expect to get the rebate - after a bit of a struggle. (I'm surprised Archway is still using the line that Staples is not an authorized reselle as there is a Staples email stating they are an authorized retailer for all their products (makes sense as they would be selling grey market stuff otherwise) at SD or FW, in addition to their own website and revised form.
There was a similar situation with Palm and Staples last year where Palm originally rejected rebates because Staples was supposed to be processing them. However Palm eventually approved all the initial rebates (Aug or Sept). But they never changed the rebate forms and made the same mistake in Nov. This time Palm tried to hold the line, but I read that people who refused to take no for an answer (BBB, AG, Planet Feedback, threats to small claims, etc.) got their rebates - more details at FW (search Palm and Staples)
Don't know how much NEC is willing to push this, but if BBB, AG, etc. complaints don't work, I've been told we should file in small claims court. It should be no finanical cost (but may be too time consuming for some) as the defendant has to pay court fees if they lose. In addition to having the T&C on our side, I'm told if the defendant doesn't show up, they automatically lose. I can just imagine NEC sending out hundreds of reps to 50 states.
In any case, I would suggest that callers make sure that NEC is aware of our options. It might also be helpful to ask if their general counsel knows of their decision. I can't imagine any lawyer stating they have a legal basis to deny the claims - but then again I'm not a lawyer, just a cheap SOB who has fought too many rebate battles.
