Nameserver problem

So I'm in the middle of the 7-10 day wait of transferring my company's domain name from the old Registrar to NetSol. In the middle of this process, the nameservers of the old company (our current nameservers) have gone down, and have been down at least the past hour, probably more. NetSol says I have to wait the 7-10 days before they'll do anything, which seems like BS to me. I mean they have proof it's processing, I don't see why they can't make the change now.

Is there anything I can do? I'm a bit concerned that the company that houses our current nameservers is going to remain lax with getting it up (which was why we changed in the first place). And this is of course assuming we're still on their NS, and they didn't remove us.
