"VH1's Free Ride" Sweepstakes
1. No purchase necessary.
2. To enter: The sweepstakes will be posted on vh1.com, a website owned and controlled by The MTVi Group, L.P. ("MTVi"
starting on July 1st 2001 and ending on July 31st 2001 (the "Sweepstakes"
. The Sweepstakes will begin live on Sunday, July 1st, 2001 at 4:00pm (EST) and end Wednesday, August 1st 2001 at 3:59pm (EST). Participants can enter once per day during the 24 hour period beginning at 4:00pm (EST) on each day of the Sweepstakes. All participants must watch VH1 each night between 9:00pm and Midnight (EST) ("My VH1 Prime Time" hours) for a keyword. Entrants will be required to answer a multiple choice question, the correct answer for which will be the keyword. Participants must fill out the required fields on the Sweepstakes entry form, including the keyword, to be entered into a random drawing (collectively "Eligible Entries"
. After answering the multiple choice question, entrants may be eligible for additional entries each time he/she requests that vh1.com sends his/her friend an email invitation to enter the Sweepstakes. Entrants will gain one additional entry for each invited friend that enters. Only correct answers will qualify for inclusion in the Sweepstakes. All participants must complete all required data requested on the entry form. Incomplete or inaccurate entry forms are void. Limit one entry per person per day. There will be thirty-one (31) grand prize packages (one winner per day for 31 days in July) (the "Grand Prize(s)"
. If an entrant uses multiple e-mail addresses to submit more than one online entry for a given day, only the first online entry for that day will count. is not responsible for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of MTVN which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes or for any reason MTVN deems it necessary, MTVN reserves the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on vh1.com. Entries that have been tampered with or altered are void. In the event of a dispute over who submitted the winning entry, the holder of the winning email account will be declared the winner.
3. Thirty-one (31) Grand Prizes will be awarded and will include the following:
One (1) 2001 BMW Z3 Roadster (estimated retail value of each car: $31,300) (the "Vehicle"
One Hundred (100) CDs (estimated retail value: $15.00 per CD=$1500 per package)
The total estimated retail value of each Grand Prize is $32,800
The total estimated retail value of the entire Sweepstakes: $1,016,800
Or alternatively, Grand Prize Winners may elect to receive a cash prize (the "Cash Prize"
of
$20,000 per Grand Prize Winner in lieu of Prize Package. $20,000 constitutes the entire prize of the Cash Prize.
4. Prizes will tentatively be filled by December 21st 2001. Dates are subject to change at MTVN's sole discretion. The total approximate retail value of this sweepstakes is $1,016,800. Odds of winning will be determined by the total number of eligible entries received.
5. By participating in this Sweepstakes, entrants agree to be bound by these rules and by the decisions of MTVN which are final in all matters relating to this Sweepstakes.
6. The Grand Prize Winners will be chosen at random, from among all of the Eligible Entries received, reflecting the correct multiple choice answer. The National Sweepstakes Company will be conducting the drawing on MTVN's behalf on or around 4:00pm(EST) each day beginning July 2, 2001 through August 2, 2001. The National Sweepstakes Company and/or MTVN will be contacting each Prize Winner by telephone between the hours of 4:00pm (EST) and 7:00pm (EST) daily. Upon notification, each winner must call the phone number provided to confirm identity and eligibility within one (1) working days. If any winner(s) is unreachable, or if there is no response from any winner(s), an alternate winner(s) may be chosen, in MTVN's sole discretion. There will be no messages left on answering machines. If an alternate winner is chosen, it will be selected randomly from the remaining Eligible Entries for that day.
7. The specifics of all elements of any prize in the Sweepstakes shall be solely determined by MTVN. Some restriction may apply. Arrangements for the fulfillment of prizes will be made by MTVN. The winners must sign an affidavit of eligibility and release of MTVi, MTV Networks, Central Broadcasting System (CBS), Viacom International Inc., The National Sweepstakes Company and BMW from any and all liability, claims, demands, and causes of action for personal injury and/or damage, theft, or loss suffered in connection with this promotion or the use or acceptance of the prize or any portion thereof to be eligible for the prizes. Except where prohibited, winner agrees that MTVN may use his or her name, voice, and likeness for advertising and publicity purposes without additional compensation. Entry into this Sweepstakes constitutes each Prize Winner's agreement to comply with these official rules. Each Prize Winner must also complete all legal documents and return them to MTVN within three (3) working days after receipt of such documents. Noncompliance will result in disqualification of the Prize Winner and an alternate winner may be selected from among all remaining eligible entries, in MTVN's sole discretion. The receipt by any winner of any of the prize components of this Sweepstakes is conditioned upon compliance with any and all federal, state and local rules and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT MTVN'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS GRAND PRIZE WINNER OF MTVN'S "Free Ride" SWEEPSTAKES AND ALL PRIVILEGES AS GRAND PRIZE WINNER WILL BE IMMEDIATELY TERMINATED.
8. The value of the prize(s) may be taxable as income. Upon receipt of any prize, each winner is required to comply with any and all applicable federal, state and local tax that becomes due with respect to the prize(s). The depiction of the Vehicle in any advertising or promotional materials may not reflect the Vehicle awarded to any Grand Prize Winner. Vehicle will only be delivered in the United States. Winner's selection of vehicle is subject to available inventory at local dealer. Vehicle will be a "base model". If the available model is not equipped with a cd player, VH1 will install the cd player that is offered as an option with the car at VH1's expense. Any additional features will be at the winner's expense. Vehicle Winners shall be responsible for all taxes, license, title and registration fees or other costs, including without limitation any travel or transportation costs, associated with winning the Vehicle (provided, however, the Vehicle shall be delivered at no cost to the winner to an authorized BMW dealer or distributor in the United States reasonably close in proximity to the winner's residence). MTVN shall not be responsible for delays in delivery of the Vehicle, and delivery is subject to availability.
9. Sweepstakes is open to vh1.com users who are residing citizens of the U.S. and at least 21 years of age at time of entry who have an active online account as of July 1. Grand Prize Winners are subject to proving eligibility, including verification of social security number. If Grand Prize Winners cannot furnish verifiable and valid proof of age within 18 hours after being notified of winning, an alternate winner may be chosen from among all remaining Eligible Entries received, in MTVN's sole discretion. Sweepstakes not open to employees and their immediate families of The MTVi Group, L.P., MTV Networks, Viacom International Inc., Central Broadcasting System (CBS), BMW, McDonalds, 1800 Contacts, The National Sweepstakes Company, any affiliated companies and subsidiaries as well as any person who has won an MTV Networks and The MTVi Group, L.P. national contest or sweepstakes in the 2000 calendar year. Winners subject to proving eligibility. VOID WHEREVER PROHIBITED OR RESTRICTED BY LAW. All entries become the property of MTVN. Additional restriction may apply.
10. All interpretations of the rules and decisions by MTVN are final. MTVN reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web site; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MTVN RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE NEW YORK COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY OF THE CONTROVERSY REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.
