My Sister got into a wreck a while back (PICS!!!)

So my sister had a car accident. She's ok, hurt her clavical a little but nothing major. We finally just took pics of the car. I thought I would show you all, and tell a story to see what you guys think.
First the wrecked car pictures.

After looking from those pics, see if this story makes since to you. My sister came upon intersection where the road she had to cross didn't have to stop (2-ways stop). My sister admitted to just roll stopping. The speed limit was 30mph both ways. On my sisters right was a hill about 50-75 yards away. My sister said, when she roll-stopped she didn't see anything. Then a F150 truck hit her on her right said, slamming her car against a near by pole on her left side which was intially 5 yards a way. They had to extricate her out of the car b/c she was pinned in. For a little more physical science for you, the truck ended up a few feet way from the car. Out of all this information you raise a few questions with 2 scenarios.

A: My sister was correct and no car was over the hill till she pulled out (remember she did admit to roll stopping).
B: My sister didn't notice a vehicle that actually was there.

If the F150 wasn't speeding couldn't a car over the hill stop or at least slowed down enough not hit her?
Could a car going exactly 30mph at time of impact do as much as damage as it did? If wasn't speeding, he should of had some time to at least break a little to slow down his truck.
If my sister pulled out right infront of the truck would it have done the damage it did if he was not speeding?

In General, what do you all think?

Thats nuts! Your sister is lucky to be alive. Is that her in the last two pics? Did you remove the stereo?
 
Ok, just making sure everyone had the same opinion as I did. I left out a few details, but i'll throw them in now.
Yes my sister is fine. Thanks for asking. Yes that's my sister in those pics.
As one police officer said to my mother, as the arrived on scene they thought it was going to be a DOA. He also said (for the one's who care) that God's angles were around her or she would have been dead. The cops all agreed that this guy was flying when they crashed... Until they found out who he was. The guy in the truck is a city administrator that could have their jobs. This city administrator has a lot of crap in his background, none good, but no need to go into that. On the police report, they wrote him going 30mph. We are currently being sued for his minimal damge to his truck. Thank God we have insurance to cover it. We are currently trying to find out if there was at least one county officer or state trooper on scene that could vouch for us.

Wow man, what a mess. It's terrible when people use their position and leverage to possibly get away with crap like this. If all the officers/observers at the scene thought he had to have been going fast, I'm sure someone would attest to this for you.

In General, I think your sister should use the opportunity of not having a car to do some more walking and lose some weight.
I also think that putting glow in the dark star stickers all over the car is fruity and distracting.
 
It's hard to determine the speed by amount of damage to the vehicles . However , your scenerio "A" could be worth checking into . You could measure the distance from the intersection to the top of the hill where the truck came over . Say the truck was traveling 30 mph , that means he was traveling at 44 FPS (feet per second) . You could then figure out the amount of time your sister had from the time the truck topped the hill until it reached the intersection . If the truck was going say 50 mph , she could have slowed , not seen anything coming , and continue into the intersection and have very little time to make it through the intersection . You could find you a Police Officer that is a certified traffic reconstructionist and he could come pretty close to telling you the mininum speed of the truck . I am not a reconstructionist , but have been a Police Officer investigating accidents the past 18 years 😉
 
Judging by the damage to your car, I would say that an F-150 traveling about 30 mph would do that much damage. An F-150 doing 45-50 in a straight T-bone would do more damage I think. The real question is how long if any were the skid marks? That's when the traffic investigator could work his formulas for the vehicles weight and length of skid marks to determine how much speed was scrubbed off.
 
The truck may very well have been speeding. Your sister still pulled out in front of him (I doubt the guy was going fast enough that he come from completely behind the hill and still hit your sister's car before she got across the street) and so I'd put the greater blame on her.
 
i bet that truck was only doing around 30mph... i had a f150 they are tough... 5mph love tap on the back end of a small dodge car costed my insurance 2500 bucks... took out all her tail lights trunk lid bumper and left quarter panel was smucked pretty good.... all that happened to my truck... scratch on the fiberglass piece on the bumper and a bent tow hook... small cars do not hold up well to bigger vehicles... my f150 was a extended cab 4x4 full tank of gas it weighed 5500lbs... that isn't much of a match for a car thats lucky if it weighs 3000
 
I think the damage looks worse than it actually is due to the roof being cut off. I figure a truck doing 30 could have easily done that much damage

From Predators post it is making me think about the fact that it was a bigger vehicle hitting a smaller vehicle. But in a normal wreck, there should of still been some time to break a little. So if he was going ~30, if he had 20 yards or more he could of reduced the inpact some. But having the roof taken off as in the pictures makes it look a lot better!!! I wish I had some pics with the roof still on. It honestly looks horrifying considering someone was actually in that car as it was.

From the look of this... cut your losses and be happy that nobody got hurt seriously.
You guys just have to ask yourself if this is worth fighting with the good possibility that a judge will rule against your sister since she didn't make a complete stop.

Little hint... if you have an accident and some sort of city worker is involved... it's State Trooper time. Friend of mines wife just had a meeting with a city truck... longest time on the whole thing was to wait for some state police to show up. City policy forbits inolement for the local cops because of possible conflict of interest!
 
It's your sister's fault...she dind't come to a complete stop. It doesn't matter how fast someone was going when they hit her...she failed to yield at a stop sign. Even if she didn't fail roll through it then she probably misjudged its speed. I really hate when people are at stop lights that are red and misjudge your speed and take a right turn in front of you making you slow down for them. My friend was in an accident once where someone pulled out into his lane and stopped and it was equal fault cause they measutred his skid makrs and found out he was speeding. If I were to do it again I'd brake casually, slam into the person, get a new car, and say they pulled right in front of me and I dind't have time to stop.
 
To answer a few questions.

she was wearing her seatbelt
we know since she did a roll stop it is her fault legally.

I'm just upset about that the whole sueing us thing. It's one thing to get your car fixed when it isn't your fault, and another when somebody was speeding and almost killing someone then sueing them. Oh well. Unless we have a good word to attest for us(state trooper, or a reconstructionist ), we're not planning to do anything about this to cost us any more financial lost.

Truck was probably speeding, but will be hard to prove. Were there long skidmarks from the truck?

This is not hard to prove. Get an accident investigator to do a crash analysis. They will be able to tell you approximately how fast the truck was going. They use physics and "crunch data" to get the number. If the insurance company is covering a lawsuit they might do one. Often it is reserved for fatalities.

 
Just let your insurance company handle things and just be glad you still have your sis.🙂 I do have a question though. Was your sister given a ticket for running a stop sign?
