To make a long story short. My friend was stopped at a rail road crossing in his 70's pickup truck. Some girl ran into the back of him going 45-50. She was in a smaller foreign car i believe. Both vehicles are now totaled.

As the girl tried to claim that the brake lites on my friends car were not working, I found this part funny in the police report:

The issue of the brake lamps of vehicle 1(chevy) not operating was not a factor in this collision. The brightness of and number of red lights at the railroad crossing far exceed the brightness of the brake lamps and should have been visible to the second party as she approached

Edit: the report also said that the girl was falling asleep because she had spend the night at her friends house. How do you see break lights, or lack of when you are sleeping?

thats pretty much pwnage haha.

That's funny...about time the innocent party didn't actually get screwed by the guilty party's lies.

Yeah...I'm bitter about some recent events. *sigh*

The breaklights actually work. I think the only reason they were not on was because he was not actually pressing the breaks he had just started to go.

If he was starting to go, surely the red lights on the crossing were not on anymore?
As such, WTF. Something is wrong here.
Either your friend was running a crossing when the lights were red, or there were no lights for this girl to see.

If he had *just* released his brakes, the girl should have seen the RR Caution lights flashing as she approached, as common sense would dictate that most people start to take off immediately after the lights stop flashing.

Or he had shoved the truck into Park to wait for a long, slow train to pass. We can't assume that his brake lights were broken...if the girl thought it was such a big deal, she should have mentioned it at the scene of the accident so that it could be investigated then.

I hate, HATE, HATE people who file for made-up medical payments when they get into an accident. I hate them worse than Osama Bin Laden, in some ways.

I've been temping at an insurance company lately, and here's a recent claim I read through.

24 year old girl, about 5'4" 180lbs, is driving a radically lifted (yet 100% clean and un-scratched) Jeep Wrangler with huge (also perfectly clean) tires. She's turning left at a green arrow, some guy runs a red and hits her tire. OK, so far I'm sympathetic towards her case. I see the pictures...a tiny dent in the chrome hub of her rim. I see the repair bill...rim repair, and an alignment, for $110. Fair enough. An extremely minor accident, but obviously this is a reasonable claim.

Then I see a claim for $8,000 worth of massages and chiropractic visits. Apparently her job as a "marketing assistant" requires such strenuous activity as "prolonged sitting", and this is a problem now that her back is giving her vague, difficult-to-prove, and very possibly preexisting pain. Obviously she wants compensation for her lost wages, among other things. Patient goals for her therapy include such gems as wanting to "go shopping at the mall all day without pain."
