My first ebay return

Well i order a cell phone which is the largest amount of money i've purchased an item on ebay so far, i was having problems with the cell phone so i took it to a local shop and they said the phone was defective and the back wasn't the original back for the cell phone.I contacted the seller and he stated that it would be replaced if i mail it back so as of today i've heard nothing from the seller, i made a paypal claim asking the seller in the nicest way i can could i please have a refund for the item.

Is their a high chance i lost my money?

I lost mine from a member on this board, I hate to say it but you're likely screwed.

Depends........you could get screwed. Paypal basically does what it wants. I paid $300 for a catback about 4 years ago and it never got sent and the seller said he sent it and I never got any money back so I lost $300.

If you already made a claim with Paypal about the transaction, they should be able to investigate it.

You said you filed a claim. There is a difference between a claim and dispute. Make sure you escalate your claim to a dispute, unless that's what you meant by saying "claim".

I only filed a claim i was hoping the seller would refund me on his own merit but i think i'll escalate it to dispute.I can't beleive there is a possiblity i can lost my money and not even have a phone,when this is over i think i'm done with paypal and ebay.

I did 2 paypal disputes a couple of weeks ago. After hearing all of the paypal horror stories, I thought my money was gone, but paypal did come through. I got my money back. 1 person didn't ship the item, no answer nothing. I filed a dispute and they didn't even reply to paypal's inquiry so I got my money back. It takes a while though. You have to file the dispute, then the seller gets like 10 days to answer and then paypal will make make a decision in 10 days (usually less). Could take a while...

Other person, I got a defective part and they agreed to a refund. All I had to do was send it back and give paypal the tracking number showing that I returned it.

If you file a claim it'll probably end up with you having to ship the item back to the seller and they will deduct the funds from their paypal and give it back to you. That is if they have the money in their account.

Yes he told me to send it back and i did but the lack of communation on his part made me just want a refund, i emailed him when i would be returning it and the tracking number when they day came.
