It just struck me as odd. To steal a car that has very little street market value is a sure sign these weren't real car thieves. Good luck and hopefully they'll catch them.

hmmm...got a point there. dont sue the mechanic. u said that is the best/fairest mechanic around you. if that is the case, i'd stay in good terms with them

Please grow up as you must be 12 years old.

He left the keys and car with someone; they now have legal responsibility to it.

When you car is in a parking lot the store has no legal responsibility to it as you never gave them power over it. (i.e. the keys)

Yes the shop is responsible for it. Their insurance will have to pay, or they will. And those signs that say "Not responsible..." = BS they have no legal bearing.

I am a mechanic and know that when someone leaves their car with me it is MY responsibility to take care of it and insure that it is not damaged.

Valets aren't responsible when you give them your keys

yes they are...

I've read those tickets they give you. They usually say they aren't. Anyhow, I hate giving my keys to a valet. Geez, imagine how I'll feel when I get a "nice" car.

Nowhere, and I wasn't taking that into account. The point I'm making is what Marlin mentioned - the "transfer of power" and thusly responsibility takes place at the car dealership and not the grocery store. One of these businesses also carries an insurance policy and a dealer license that holds them responsible for vehicles in their care.

So far though, I haven't seen anything where the mechanic is saying "Fvck you, you pay" - so don't be chomping at the bit to sue. Give him a chance to make amends ... you know, by letting you have that nice Mercedes C230 until you get a new set of wheels ... ;)

They give you those tickets in hoping that it will get some poor sucker to not hit up their insurance company if something happens. If a valet zooms off in your car the second they get in and hit a telephone pole... do you REALLY think they aren't responsible? If they park the car too close to someone else's, and someone gets a dinged door, why is your fault and why should you foot the bill for it?

In this case, the car was in the responsibility of the mechanic, and their insurance should cover it. This is different from grocery stores because the express responsibility is placed in the hands of the property owner. If you were to simply park on their lot, then it wouldn't be their responsibility, but once they have the keys and the order to do something with the car, it isn't expected that you should keep watch over your car day and night until the work in finished.

Well we filed a police report if the car isnt found in 72 hours then I go from there, not sure which insurance will cover it.
