I don't recognize hate crimes. The cop should be fired for not doing his job, and the drunk should have had his ass beaten.

Nobody got hurt....he didn't lay a hand on her or even use foul language, he simply stated his displeasure with the Puerto Rico flag. (I'm guessing in his drunk state he thought it was a Mexican flag)

Pretty much a waste of court time.
So crimes only happen if someone is hurt?

Yes....usually that's how it works. If yelling at people is a crime most Americans will have to be arrested. (He didn't even really yell at her)
So brandishing a weapon and pointing it at someone, or threatening someone with a knife and swinging it in their face but not hitting them, isn't a crime in your eyes?

He didn't have a knife or gun. He didn't make a death threat. He simply stated his displeasure with her flag shirt.

I believe he meant hypothetically. The answer to this, I think, is that threats of violence and "intent to do harm" are recognized as crimes.

I never said he did.

You said it's only a crime if someone is hurt. In both of my examples I asked you about, no one was hurt. So I was asking if it was a crime in your eyes.

It would be best if we focused on the incident that actually happened and not on hypotheticals. He stated his displeasure at her flag shirt. Misdemeanor yes (drunk and disorderly)....Felony no.

Depends on the situation. If I brandish to defuse a situation, that's O.K., here. If you threaten me with a knife, I can blow your head off, here. Chicago, probably not.


Back to the OP. Hate crime? Nope. This, 100%....I don't recognize hate crimes. The cop should be fired for not doing his job, and the drunk should have had his ass beaten.

nothing here to be a hate crime at all. officer should have stepped in much sooner to shoo him away or arrest if he refuses to move on. she seemed to be overly sensitive before he got close to her. Puerto Rico isn't a state; it is a territory. they have us citizen ship but can't vote for US elections. they do have their own government of sorts though.
