MS licensing question

I have a question about OEM MS licensing.

I understand that the strict use of terms is that OEM licensed software lives and dies with the OEM machine.

Let's say that I buy 2 machines from Dell. 1 of them has MS office Pro. The other does not. I keep the one that has Office Pro, and I give the other to my friend. The next day we realize that he needs Office Pro, but I do not. Can I uninstall the software and then install it on his, legally?

If Office Pro came with your Dell, than it will not install on anything but a Dell, at least from my experience. But this is 3 year old experience and may not be as reliable.

In any case, OEM can be installed in other computers, just as long as you have one physical copy per installation.

They are both dells and almost identical and are within 2 weeks of the same age of production. Basically what I'm asking is if I can transfer an OEM license. I realize you answered the question. They have been touchy about it lately. I want to transfer the license from me (who will not use it) to somebody in a company (who will). I just want to make sure that if that company gets audited, it won't come up and say, sorry, this particular license doesn't belong to this computer - OEM licenses being different from retail ones, which can slip from computer to computer.

The company keeps quite good records and does keep all their OEM CD's in order.

I don't see anything wrong with it. As long as the copy is installed on only one machine.

You know what you could do, is call Windows piracy line and and ask them for sure if it is piracy what you are doing.
