You can deny everything. What kinda lawsuit would she bring up against you. None that would hold in court from what I see since she agreed to handle it outside of insurance.

You hold the cards dude.

And this would make you a total ass. Just have her fax you a copy of the estimate and if it looks like it checks out then pay it.

Depends a great deal of the insurance company, age of the insured, other accidents/moving violations, etc.

Judging by the content of the original post, and the fact that he is a student, supposition would suggest that the original poster is quite young. As such, it is certainly possible that the insurance rates would be raised with an additional at-fault accident - how much again depends on the factors mentioned above.

With either approach, if any money is indeed saved, please invest in this.

$500 is not that bad, it probably would cost her that to repaint hte bumper- if she choses to do so.

Just pay he. $500 is actually cheap. It doesn't take much for $500 in damages.

you be surprised at how little damage it takes to cost a $500 damage. The fact you made contact and busted your hood, headlights AND bumper meant there is significant damage to BOTH cars. My car was rear-ended by someone while I was dead stopped. He didn't brake in time and "bumped" into me. My car had $4500 worth of damage from this little encounter while his car had a few dents, so I know how expensive these things can be.

Lots of times you can't see the damage till you remove the bumper and inspect the internal parts. Most autoshops will charge $200 just to do the inspection (2 hours of labor at $100/hr). The bumper is worth $200 WITHOUT paint. Even if the bumper can be reused which in most cases they dent or crack, painting plastic will cost easily $300.

For all you people who ask about a police report, in California at least, police WILL NOT take a report if there is no bodily harm AND both party agree regarding fault and to exchange info on scene. Since you rear-ended someone STOPPED at the light, it's a no brainer. I would pay the $500, and ask that she sign a waiver form and move on. If she gets wise and go to a body shop and get a REAL estimate AND file an insurance claim (which she is allow to do at anytime), you will end up paying a whole lot more -- with estimate or without.

And also, just to be safe, have someone else (either a neutral party, or someone from both parties) sign as witness to you guys agreeing on that document and that no one has forged a signature or anything like that. Also make a copy her as well.
