Michigan Supreme Court To Hear Illegals' Workers' Compensation Case

WSJM Radio 1400/AP Benton Harbor, Michigan (1/27) reports, "An undocumented worker from Mexico injured at his Muskegon job says he's entitled to receive workers' compensation. The case involving 46-year-old David Sanchez will be heard this spring by the state Supreme Court. It will mark the first time the high court has weighed in on whether someone who illegally enters the United States is entitled to the same job benefits as an American citizen. Sanchez now lives in Muskegon. He was working at the Eagle Alloy foundry in Muskegon when his right hand was crushed and burned in a press machine. Sanchez underwent seven operations and physical therapy before returning to work. Eagle officials fired him in August 1999 after learning he had provided them with a fake Social Security number."
 
If the accident was the fault of their equipment, it shouldn't matter where the guy is from. Just because he's illegally here doesn't mean they can make him a crash dummy. Don't get me wrong, I understand why they would fire him, but if they caused the accident, they need to take care of him.
 
In my opinion, being that he is illegal he should not even of have been there to get hurt. I side with the company on this.

I relate it to driving without car insurance. If someone runs a red light and hits you and you do not have car insurance, then the wreck is your fault for you should not have been on the road to begin with.

The case is already won, they are our Southern Citizens.

Actually they are our first class citizens since they don't have to pay taxes.

The rich are our second class citizens.

The working class is our biatches.

 
How is he entitled to Workmans Compensation if he never paid into the system (fake SSN). Isn't that like Unemployment? How did the company, and the IRS not know about the fake SSN sooner? Somethings fishy methinks.

Additionally, if he recieved ANY public funds for his massive doctors bills, then he is Deportable. If he recieves, or applies for Unemployment, Welfare, Medicare, Medicaid or SSI, he is Deportable. He is already an admitted felon by using a fake SSN card, in addition to additional charges for being an Intended Immigrant without documentation.

The company should be liable for medical bills only related to the repair of the injury, then turn him over to Immigration for summary Deportation. The Michigan State Supreme Court is fairly realistic in most of it's ruling. They stray at times, but nobodys perfect. Let's just hope that they do the right thing.

Awww poor Maluckey, you didn't get the memo either? We don't do that deportation thing anymore with our Southern Citizens. What? You don't like paying for them? The President does, so you should too.

Thats hasnt been passed, and will NEVER be passed. This guy should be deported. He shouldnt get a dime.
 
He got injured while working at the alloy company. The company should be at fault for not verifying his identity prior to employement. My quess he was working for cheap so they did not care where he was from. Spending a few $$$ on a quick background check would not have been a bad investment.
 
I think the company should have to pay for the medical bills and be fined. The guy should get nothing. To allow the company not to pay anything will just make they want to hire more illegals because they no longer have to be concerned with safety.
 
Since both were at fault they should both be punished. He should be deported as soon as he has recovered and the company should have to pay his medical expenses.

This is the vital point, and why its insane to say that companies don't have to pay for accidents that occur involving illegal alien workers. Why in this case it may be that the company was honestly deceived, although I question how through they were in determining whether he was legally able to work in the US, but this issue will come up in other cases as well. A company could CLAIM they were deceived by bogus information that the worker provided, but actually know that he was an illegal from the moment they hired him. If you say that the company has no civil liability or need to pay medicial expenses if the worker is an illegal, they have a huge incentive hire illegals and continue their unsafe work practices rather than take steps to improve worker safety. Futhermore, no liability in accidents would give illegals a huge advantage over legal workers if companies make an economic assessment of what hiring procedures they should practice.

This sounds like Wal-Market... Don't give them any ideas! Of course they no doubt have already done this.

I agree that both should be punished.
