i guess that's one way of doing it. not a good PR move.


edit: some explanation

the way mass torts work, you have one potential victim sue the defendant at a time (or several different victims all at once, the key is separate cases), trying different theories of recovery and fact patterns until you find one that's a winner in court. once that winner's established, the defendant is basically prevented from arguing otherwise in later cases with other plaintiffs (which is called collateral estoppel). then, you bring your class action alleging the thing you already proved in an earlier case.

doing this heads that off because now there's just one go at it.
