I have no sympathy for any guy who gets taken to the divorce court cleaners because he cheated on his wife...especially in a "community property state" like California.
She is LEGALLY entitled to 1/2 of everything earned while they were married.

I'd award her $10 million and get the fuck out on my court, UNLESS she can prove she was DIRECTLY involved in the projects that Me Gibson was in that grossed all that money. If not, $10 million is a damn good judgement for 28 years of sitting on your ass and being pampered.

He could have chosen not to get married. He is an adult.

If you cannot afford or do not want to give up half your assets, don't get married period.

No one forces anyone to get married.
 
Some of the people in this thread have no idea about children apparently.......

I can handle just fine 8-10 hours at work, but 20 minutes home with the kid has me ripping my fucking hair out because of the insanity of a 4 year old. I don't think people understand what its like to actually TAKE CARE OF children. If you are doing a good job, neither you or the children just "sit around being pampered". Its a huge pain in the ass and requires a lot of mental control that most people don't have.

When you have Mel Gibson's money, you do. And let me tell you, taking care of kids does not equal $400 millions. FU! Hell, it doesn't even equal $10 million, not even close. So don't give me this, "raising kids is hard" shit. Yes it is hard, but 99% of the population can do it for less than $10 million. I actually think $10 million is pretty damn generous for watching your kids be raised by the nanny.

I complete agree, it's a stupid move. But that still doesn't justify a BS $400 million settlement for someone that didn't do jack squat for it. Again, she put a lot of time into the relationship and help raise the kids, so I think $10 million is a good parting gift. This "half" shit has GOT to go.

Last time I check, the wife could just divorce the hubby FOR NO REASON at all and still get 1/2 of his everything. I know for a fact that a wife from a guy I knows very well just left and took the kids and now he is paying child support AND 1/2 of his stuffs are gone to her just because she felt "liberate" to start new.

And people are wondering why the rate of marriage in the US is down the toilet.

By movie residual, I was assuming any money he earned for movies he was part of while he was married. Not that I agree with it but if they say half of everything, it makes sense that she'd get half the contract that says he'd get a percentage of movies he made. It would be odd though if she gets half of anything he does does after the divorce.

Not really. It's awkwardly and incompletely phrased, but I'm sure that "every future move residual" means every residual that comes in the future for movies he made while they were married will be split, not for future movies not yet made.

Correct, she gets half of whatever money is further made from movies made during their marriage, 1979-2010. So if there are any profits from Mad Max being shown on TV/DVD/Blu-ray sales she gets half of what Mel Gibson gets. D: So any $$ he makes after this period is all his.

Everyone has children. Having children isn't special, shouldn't be regarded as abnormally hard, and is, in a lot of cases, just plain selfish.

I don't live in a no fault state so I am not sure. But as I said in my previous post (#13), the thing about the high earner (hubby or wife) should give up 1/2 of his or her assets just because of divorce is beyond stupid IMO.

California is one of the handful of community property states.

Assets gained while married are community property and are split 50/50.

In community property states, assets and income(other than say inheritances, etc) gained during marriage are split 50/50. You buy a car with income earned while married, its 50/50. You buy a house with income earned during marriage, its 50/50. You buy a lottery ticket and win, its 50/50. You are married for a long time and fully vested into a pension, money put into pension and accrued while married is 50/50 when you retire. You make a billion dollars? Its 50/50.

The thing about community property states is, generally pre-martial property/wealth is protected.
