Meet my neighbor....the convicted sex offender.

Received an "urgent" email from our neighborhood association the other day. Apparently someone noticed that there was a convicted sex offender living in our neighborhood (this is public info in the state of GA) and that we should all keep an eye on our children. Followed the link provided and came face to face with this poor SOB.

Geez... not that I condone illegal activity, but sounds like a witch hunt!!!

We're talking statuatory as in "GF a year younger" or something, aren't we?
(because forced sex would be a rape conviction, child abuse would be child abuse)

Did you notice the offense? It was statuatory rape. This guy probably got tagged for doing his underage consenting girlfriend so I don't think he is much of a threat. Find out a little more info before you pass judgement. If he is a child molestor then find a way to make his life miserable enough to leave the neighborhood.
 
Actually if you look at his DOB and the conviction date, he was probably only a few years older than the girl he was with. I don't know this for a fact of course, but if you are over the age of consent and your gf is under....even if you're only a year apart in age....you can be convicted of statutory.

EDIT- I see most of you are picking up on the point I was attempting to make. (I'll see if I can find details on the off chance he was diddling his 3 year-old neighbor or something). It's a shame that this kid's life is likely ruined because of a legal quirk.

I thought it was funny/pathetic that my neighbors were in an uproar over this without taking the time to think about what this kid really did.

I don't think Fausto was passing any judgement other than the fact that this guy is probably not a child molestor and gets to be publicly defamed just because he buggered his HS sweetheart and her parents found out about it.
If that's what happened, at least.

16-6-3.

(a) A person commits the offense of statutory rape when he or she
engages in sexual intercourse with any person under the age of 16
years
and not his or her spouse, provided that no conviction shall
be had for this offense on the unsupported testimony of the victim.

(b) A person convicted of the offense of statutory rape shall be
punished by imprisonment for not less than one nor more than 20
years; provided, however, that if the person so convicted is 21
years of age or older, such person shall be punished by imprisonment
for not less than ten nor more than 20 years; provided, further,
that if the victim is 14 or 15 years of age and the person so
convicted is no more than three years older than the victim, such
person shall be guilty of a misdemeanor.



I added the bold format to the victim age ranges.

So he was either 20 and the victim 16 or younger, or he was 19 and the victim was 15 or younger.

If this guy just had sex with his GF then I agree with you but if he is a child molestor then no matter how much time he has done it is not enought time and I would never leave this creep alone.

I agree, statitory rape is different from 'normal' rape. It just means the girl was too young to 'consent'.
 
The person has to be under 16 in GA for it to be Statutory rape, almost all states are different in some way or another but in GA it is anybody under 16.
Punishment: Typically, statutory rape is considered a felony carrying a 1 to 20 year jail sentence. But, if the victim is 14 or 15 at the time of the act, and the defendant is no more than 3 years older, it is a misdemeanor.
 
So he probably had sex with his 15 year old g/f...

Not the brightest thing to do, but I hardly think he deserves being labelled a sex offendor.

Now if he was corn-holing a 4 year old, I would feel much different.

It says statuatory meaning that the victim was willing but under the legal age.

To me that means he just had a young girlfriend and her parents found out they were doing the nasty.

If it had not been voluntary or if it had been a child, he would not have been sentenced to statutory rape.

If you really look at him, he's not the cutest thing out there so he has to pretty much take what you can get. The nieve young girl probably saw him as a status symbol..Woo Hoo, I have me a college boyfriend.

It takes two to tango, he just got nailed in a grey area.

Read my edit above. I was pointing out that he is likely just a victim of a legal quirk, and guilty of nothing more than getting caught with his younger GF. I was also annoyed that my neighbors were fanning the flames by sending the "lock up your children!! Sex offender in the area!!" email around without really knowing the facts. Like this kid hadn't been through enough without my suddenly overzealous neighbors running over to his house telling his parents to keep him locked up.

BTW- since he's obviously not in jail, he must have been no more than 3 years older than the "victim" or he'd still be in the can (minimum one year sentence for non-misdemeanor conviction if I'm reading the law correctly).

How much press this guy will get for moving to a new place you probably want have to worry about him anyway, Ga and SC don't know about the rest likes to put the persons pic and description on everything from tv to newspaper to internet.
