Heart doesn't own the rights to their songs. As long as the campaign is paying their licensing fees, there's not a whole lot Heart can do about it.

The point is they should respect the views of the artist.. I don't care what you own this could backfire on them. We'll see... There are millions of songs out there and I would think they could find one that an artist might "WANT" them to play. Eh?

Musicians don't own their product - the label does. Heart can make a fuss over their music being used, but they have no say in the matter unless their contract stipulates as much.

On Tuesday morning (September 9), the 1977 hit played before McCain and Palin showed up for an outdoor rally in Lebanon, Ohio. Heart's Ann and Nancy Wilson initially complained when it was played at the Republican National Convention in St. Paul, Minnesota, before Palin's appearance last Wednesday and after McCain's speech on Thursday. Palin gained the nickname "Sarah Barracuda" while on her high school basketball team, and Republicans are likely using the rock anthem to remind voters of the Alaska governor's reputation as a tenacious leader.

"The Republican campaign did not ask for permission to use the song, nor would they have been granted that permission," read a statement from Heart's camp. "We have asked the Republican campaign publicly not to use our music. We hope our wishes will be honored."

Later, in an e-mail to EW.com, the Wilson sisters said that "Sarah Palin's views and values in NO WAY represent us as American women. ... While Heart did not and would not authorize the use of their song at the RNC, there's irony in Republican strategists' choice to make use of it there."

The Republican Party did in fact obtain the necessary license to use the song, which can be played when a venue pays a blanket fee to ASCAP, the organization that protects music copyrights.

While the Wilsons are clearly upset, "Barracuda" co-writer and former Heart guitarist Roger Fisher (Nancy's ex) has a different outlook. He's happy to receive the publicity, he told Reuters last week, and he pledged to give part of the royalties from the song's use to Democratic presidential nominee Barack Obama's campaign.

It depends entirely on the contract as to who has the publishing rights, and varies considerably from artist to artist.

This is complete non issue if they are paying licensing fees, esp. if per above post the SH*TTY song's co-writer doesn't mind anyway. Let's see if we can make this a pivotal election issue, though!
 
Ericlp, it's probably pretty hard. To paint with a broad brush, most artists really hate the GOP. (I always thought it was funny when I saw the stories about Bush's ipod or whatever, considering how many of the artists on there probably loathed him) I'm sure Toby Keith is waiting by the phone for a call though.

God I hate Toby Keith. I went to his shitty bar in Vegas and stole an oversized novelty jelly jar. Classy, I know.

I actually didn't know that. Considering the songs he was writing for awhile I feel like it was fairly reasonable to confuse him with the Republicans.

That being said, now I'm just a little bit sadder to be a Democrat. (then again, he said he grew up as a Southern Democrat... which is something very different than a modern Democrat)

Of course, he also stirred up some controversy when he basically said Obama acts like a white man.
 
I heard the McCain camp has contacted Bob Seger wanting to use his song "Still the same". Seger replied with "Turn the page"
 
Heart can complain all they want, the music was licensed for that use, and the campaign can continue to do so. What's this BS about having to "respect the wishes" of the band? There's no such requirement.

Besides they are donating some of the royalties paid by McCreepys campaign to use that song to Obamas campaign
