Man sues airline for having to sit next to obese passengers

An Australian man has leveled a broadside against American Airlines — for seating him next to two plump passengers on a 14-hour flight, an ordeal he claims left him with permanent injuries.

Michael Anthony Taylor, 67, said the airline refused to allow him to change seats, leaving him “crouching, kneeling, bracing or standing” for much of the flight from Sydney to Los Angeles, the Sydney Daily Telegraph reported.

He said his squashed position by the window during the long flight worsened his scoliosis — or spinal curvature — and caused lower and upper back injuries as well as neck bruising.

The Wollongong resident is suing the airline and seeking more than $100,000 in damages.

American Airlines told The Post in a statement: “We just received the lawsuit and we are reviewing the allegations.”

The Boeing 777 took off from Sydney on Dec. 28, 2015, with all 310 seats occupied, the airline said.

“I don’t hold any malice towards the people in the seats next to me — they’d paid for a ticket too,” he told the paper. “The airline could have put me in a crew seat or moved people around but they did nothing.”

His attorney said the wide-body case could lead to a push for airlines to make their economy class more comfortable.

“If Michael is successful, this throws open the doors to potentially a large amount of cases against airlines and how they’ve designed their seating and how they seat passengers,” Thomas Janson said. “There will be a huge outcry against the way airlines furnish their cabins, particularly in economy.”
 
I keep hoping the airlines charge based on weight. It could offset SO MANY problems.
It doesn't get more fair than that. Buy your ticket with an estimated total weight of passenger/luggage, then weigh in at the check in for the final tally, and either pay more or get a refund.

Then, everyone will pay more money per ticket to make up for the loss in seats.
Simple, charge the obese passengers the seat they spill into and airlines shouldn't sell said seat.

Whilst I agree mostly, that is terribly unfair to those who are simply much larger in structure, whilst not actually overweight.

If the people were so large they caused these issues to the person next to them, they should have been charged for 2 seats?

Life's a bitch. I'm 6'5", ~225#, so I'd be in the upper percentile of fare price. The Chinese guy next me to will be getting a bargain in comparison. That's the way it goes. OTOH, I can walk through the city, and people don't tend to fuck with me.

No matter what mommy said, life isn't fair or equal. You make the most of what you have, and adjust. If you're 300# and frequently fly, it'll be good motivation to lose some weight.
 
I sat next to a guy to who up 2/3 of the row. Everyone that boarded after probably saw a look of dread on my face while I hoped nobody needed to squeeze in.
 

I can't find the link but the story was this was the middle of the flight and the man got up to talk to his friend in the chair in front of him. Notice he is stilling on the arm no way they would allow this and also the empty seat/s behind him that was his.

Seriously why would a stewardess seat a man on the seat arm blocking the aisle, and then take a picture of it.
 
I have no issues with them requiring people who spill over into the seat next to them to be required to purchase that seat as well but I am curious as to why the "two plump passengers" is relevant if he was sitting in the window seat. But the flight crew could have at least swapped them around so that he had the aisle seat so he wasn't squished into the side of the plane.

If i remember correctly the big guy's seat is actually the window seat and the smaller guy said fuck that's there is not enough room and wouldn't let him in. How is that guy supposed to only take up 1 seat when he's the size of at least 2? Yeah there's no way they would take off with them seated that way. Any which way that dude should/would have had to pay for 2 seats.

Why? It's not a moral issue; more weight costs more fuel and that is the airline's single largest expense, which brings me to...

Everyone should pay for what they use, if someone uses one seat per cheek then that's what they should pay for. Bring more weight onto the plane, regardless of its form, and you should expect to pay more.
 
I would have no issues if they charged extra if you're over a certain weight. It's silly to fuss over a few pounds in terms of luggage when you got people that weight like 250lbs+. In all reality though, I doubt 100's of pounds makes much of a difference when you consider a plane's power and it's own weight. It's like being worried about grains of sand in your car taking away your gas mileage. Overweight people on planes is more of a physical space issue. Someone who can't stay in just one seat should have to buy two.

I suppose if you had an oddball flight where it just so happens that everyone is like 350lbs+ then that may add up. Might have to get the ground crew to install the JATO rockets system for that take off. 😛
 
I had a flight where a whale was next to me. His first move was to raise the armrest and let about 6 inch's of hot sweaty blubber (it was a hot summer day) flow into my seat.

I said, "excuse me", put the armrest down and said, "it stays down, and you stay out of my seat". In such a manner that he didn't attempt to raise the armrest again. Fortunately it was only about a 40 minute (gate to gate) flight.

Well he could be embellishing the conversation to sound more manly. After all he is the mtnman.

Id probably be pissed myself and come off as somewhat aggressive if the same happened to me. The obese guy knows exactly how big he is and knows the arm rest is digging into his side. He also knows his fat will spill into the neighboring seat and offend the guy sitting next to him.

If you ask me, the fat guy was the one being uncivil for deliberately intruding into the seat of his neighbor. He knew exactly what he was doing and wanted to be comfortable at the expense of someone else. Your comment about civility needs to be directed to the fat guy, not MtnMan.
