So I saw. I don't care if you're insane or not, if you beat someone to death, especially a family member, you should not be out of wherever they put you in just 4 months. That's simply disgusting. I thought Texas was better than that :(

Insanity is not a defense, its an excuse. Insanity getting you off the hook makes about as much sense as saying "I was drunk" and they getting away with a slap on the wrist.

In Texas we'll execute a mentally retarded person, but release someone who murders his sister after 4 years of treatment.

Edit: 4 MONTHS. Years was a typo.

There is supposed to be a difference between murdering someone in cold blood and doing it because you thought they were Satan. Do you also believe that mental retardation is a just an excuse? Is self defense just an excuse too? Murder is murder right?

Do you really think the entire legal system hasn't thought this through?

Self-defense doesn't fit in here, because that's a case of "your life or mine". No one expects you to just let it happen.

But if a mentally ill person can't distinguish between murder and some other more justifiable act (like killing Satan, I guess), then he is equally dangerous, if not more so, than someone who killed intentionally. That's why I think mental illness is not an adequate defense.

If I bumped into another car intentionally, I should get charged with assault. If I do so accidently, I should not. But if I can't tell that bumping into other cars are wrong, then I'm more of a hazard than anyone else.

Exactly. I'm not saying it shouldn't be an excuse, but if it's going to be an excuse then they need to come up with better punishments than 4 months in a mental hospital.
