Police officer tells his captain that he saw the fellow painting on the side walk... seems not to be a truthful statement.. I gotta be careful here cuz some of my relations are NYPD... but, the 'chalked' writing looked older than a day to me.. and it took 6 officers and supervisors... wow!!!!

More importantly is the reasoning behind this protest by the bikers.. and the attitude toward it by some of the more 'powerful' decision makers... I guess a poster is more appropriate.

Generally, I'd agree with the police and suggest this guy should be arrested for defacing public property - you have a right to have your message read, but do it on your own property. However, this guy made a point of using only water-soluble chalk which bio-degrades in less than a month, so they probably should've just let him slide. On the way to work every day, I still pass graffiti left on sidewalks and buildings by the anti-World Bank crowd over two years ago.

Not that it really matters here but I partially agree that this was not handled correctly but I am also disgusted at the distraction from the Topic issue.

This guy obviously didn't print this message at the time of the interview. Nothing says that there wasn't an officer that viewed it as he did it previously though and didn't do anything about it at the time... That is neither her nor there though. Fact is WHOMEVER did this didn't just write on the sidewalk with chalk.

Per this guys own admission, it can take up to 30 days to go away without someone going out with a hose. Why should anyone go out and clean up his mess? If you use spray paint, I can go out with solvent or a sand blower and clean it within minutes but that is not the point. It was graffiti not just sidewalk chalk.

There is nothing about preventing this that hinders anyones free speech. He can say what he wants to "chalk" all he wants. If the cops were to have included "speaking his mind about Bush" then I'd also agree that his free speech rights were violated.
