Man arrested after posting FB photo with baby while holding a bb gun

COLERAIN TOWNSHIP, Ohio —A man is being held on $2,000 bond after he was accused of posting a photo on Facebook that showed him with a baby and a gun.

Dominic Gaines was arrested early Sunday after police said he posted the photo Saturday night. He was charged with one count of child endangering.

Police said the gun turned out to be a BB gun.

"Due to close proximity of the BB gun to the child, there is a substantial risk of physical harm and safety of the child," court documents stated.

In court Monday, Gaines said it was all a misunderstanding. His attorney said Gaines was holding the 1-year-old girl playing with the gun while visiting with some of his relatives.

The attorney said Gaines' ex-wife saw the photo and called police.

Gaines' father told News 5's Andrew Setters that the BB gun was pointed toward the ground, not the baby.

At his arraignment, Gaines’ attorney said the baby was never in any danger.

"What had happened was he had his nephews over, as well as his daughter, they were all playing. He was playing with a BB gun with his nephews. His brother walked in and wanted to take a picture of him with his daughter, he incidentally happened to be holding the BB gun in the picture," Andy Schoenling said.

he probably is thinking of this because he is too fucking stupid to know the difference between a bb gun and .177 pellet gun. to be killed by a bb gun would pretty much take an act of god.

You are wrong, it wasn't reckless at all. Think about the mechanics involved in shooting someone you are holding, with a rifle. It would be difficult even if you were actively trying to do it.
Edit: I see it wasn't a rifle. Easier to accomplish, but to accidentally screw up like that while seated would take a special kind of stupid. Still not reckless.

No the photo isn't all we know. We know he was arrested.

That means people who know more about it than we do thought an arrest was warranted.

You saying it was bogus is you claiming to know something you can't know. And being willing to err on the side of a guy who poses with a gun and a baby and not on the safety of the baby.
