Any private institution can practice any kind of service-discrimination they want so long as they aren't getting money from the federal / local governments. In this case the guy has a shot at winning provided nothing is settled out of court, unless the A's own exclusive rights to the stadium and paid for it with every penny out of their own pocket.

The only direct control that the layman has over the market is money. By sueing (sp?) a business for its doings, one sends the strongest message that they can ofhow their practices aren't right (illegal even). As the article states, the baseball team has sinced changed their policy to be more accepting of the law and ones rights.
