..and the fence it self. is it actually on his property? he may be entitled to a gate but the structure on both sides of the road may be on BLM land or someone elses property. Lots of questions here.
 
so the guy donates 100s of acres of land for public hiking use and then people bitch when he puts up a fence around the rest of it.

yeap. the guy does something good and does not want his land ruined. then people whine and want to sue to take that from him. really it amazes me at times.

..all existing roads were/are easements on someone elses property. The sidewalk in front of your home is an easement on your property.

Good for him.

I think James is a great guy. Just the fact that he's donated hundreds of acres shows this.

It's his property.. Just because someone made some nature trails on it does not mean anything.

He should fence the trails off and replant them as far as I'm concerned.

That's why the solid metal part of the fence doesn't go all the way across the road. It can still be accessed.
 
Sorry all, but 50 years of continuous trail access by the public, 25 years designated as an 'official' trail by the county, and 9 years under the current owner's (Hetfield's) ownership, indicates an easement. I respect property rights as much as anyone, but this is how property rights work. You can't just allow the public to have access to your property for years and years, and then just change your mind and take it away. Remember the old adage, 'Possession is 9/10th's of the law.'

Where is the line drawn, though? It's his property.... And he says he erected the fence due to vandalism. He doesn't have to put up with people vandalizing his property.
