Most modern cranes of that size wouldn't do this these days. They have on board computers to keep from losing their load.

Weight/strain sensors can measure how much the load is, position sensors measure the angles and how far the boom is extended. Too far and an alarm sounds and stops movement away from stable.

Why do you assume somebody is going to get sued? Some people do pay for their damages without having to go to a court you know.
